I Became a Genius Law School Student Episode 81

Heo Jong-il a third-year junior lawyer at Jin & Ahn sighed heavily and looked at the monitor.

“Ugh. “What kind of trouble is this?”

On Jong-il Heo’s computer there was a mountain of internship applications from law school students from all over the country.

In fact there was no need to read and evaluate all of this individually.

This is because all you had to do was input each applicant’s undergraduate degree and law school GPA into Excel then filter them based on certain criteria and read only the surviving applications.

‘I don’t have any credits this time. Attorney Seong Jin-tae also gave a strong warning not to filter based on academic background…’

This left us with no choice but to read all the documents submitted by each person.

Of course Heo Jong-il did not initially review all applications submitted for this practical training selection.

Aside from him there were several other junior lawyers assigned to this task.

However even with 1/n there was an absurd amount of applications piling up.

Indeed Jin & Ahn was praised as the undisputed number one in the industry.

The number was beyond imagination as everyone applied with the mindset of ‘I don’t know’ or ‘I’ll try to catch a persimmon that I can’t eat.’

What was more serious was that this practical trainee recruitment process required some kind of ‘assignment’ to be attached to the application.

Since it was not an easy task Heo Jong-il had been reading the text with his eyes glued to the task for several days already.

‘No what I usually do is just read without paying attention.’

As I was assigned this job I was removed from the trade dispute incident response team that I was originally in charge of so in fact there was not much change in terms of the intensity of the work.

Jin & Ahn was famous for treating junior lawyers harshly to the point where they ridiculed themselves as blue-collar workers who just sat in the office and worked.

Nevertheless there was a reason why Heo Jong-il was complaining.

‘…even if the level is low it’s too low.’

The central issue raised in this intern selection task was the Serious Accident Punishment Act.

The idea was to develop a logic that would allow corporate managers to avoid responsibility for damages suffered by workers in industrial settings.

In addition other special laws such as the Occupational Safety and Health Act and occupational manslaughter which is a crime under the general criminal law had to be considered together.

It was true that it was difficult as unfamiliar special laws were introduced.

I also sympathized with the purpose of finding out how flexibly one could deal with a topic one had never studied before.

However just because something was never learned it did not mean that it had ‘nothing to do with’ what was truly learned.

‘this. In the end the supervisory responsibility has been expanded.’

A hint was that in the assignment the crime of manslaughter through professional negligence which is an article of the general criminal law was mentioned.

By sufficiently researching the special requirements and exceptions that exist only in the Serious Accident Punishment Act and the precedents dealing with them it was possible to compile them based on the general legal principles of criminal law.

However in Jong-il Heo’s opinion most of the assignments submitted by students were in the wrong direction.

Overwhelmingly they were overwhelmed by unfamiliar legal principles and were unable to remember how to apply even what they knew and ended up completing only the required amount of homework.

    ‘Well he’s a little better.’

Then one application form caught his eye. The name of Baek Seo-yul a freshman at Yonhee University was written on it.

‘First of all I clearly understand that the Serious Accident Punishment Act is ultimately rooted in criminal law.’

There were a lot of reports that did not even capture the essence and were just nonsense.

Because of this Heo Jong-il who had low expectations classified the report he had just read into the folder for those who passed the first round.

‘Anyway Attorney Seong Jin-tae will make the final decision so I guess I can upload it a little loosely.’

You did it so let’s fuck it together. Heo Jong-il smiled bitterly as he made up his mind.

In his opinion Seong Jin-tae was a eccentric among eccentrics.

Within the company Seong Jin-tae was already a big name among big names with no reason to bother with chores like selecting interns.

But when such a person suddenly intervened the work to be done multiplied.

There was even a rumor going around that he insisted on holding the briefing session himself and when he came back he called in the employees who were in charge of preparing for the briefing session and overturned it.

Originally at Jin & Ahn’s intern recruitment briefing session it was customary to set up tables differently depending on educational background.

However it is said that he caught the people involved like catching rats saying that he had clearly told them that they should not differentiate based on such external factors.

‘Well it’s a shame they got robbed.’

As with any law firm the relationship between Jin & Ando’s junior lawyers and office staff was not very good.

The office workers were full of complaints saying that Junior was treating them as if they were servants of a superintendent’s house.

Lawyers were displeased saying that employees who had no idea what to do with the law if it was a lawyer’s law were talking to each other at work just to save some free time.

I didn’t feel too bad about the rumor that the employees were scolded for this but the problem was that there was no police station across the river.

The fireball also landed on Heo Jong-il’s feet.

There are still hundreds of applications left for practical training.

    ‘Aaaah.’

    But what can you do?

If you were to peel it from above you had to peel it.

From the outside it may not seem like a great lawyer at Jin & Ahn but in the end he is still an office worker who receives a salary and has to look after his superiors.

‘Ugh. It’s dirty so I have to open a business…’

Of course it’s just a thought. Heo Jong-il still had a lot left to learn and do at Jin & Ahn.

So in the end whether you like it or not you have no choice but to return to the task assigned to you.

Heo Jong-il skimmed through the application form and report again with uninterested eyes. As expected most of them were of mediocre quality.

Of course Heo Jong-il himself was a novice as a lawyer but his view of the situation was bound to be different from that of students who had no practical experience.

Meanwhile two reports caught my attention.

[Shin Seo-jun first year law school student at Hankuk University]

[Han Seol 1st year law school student at Hankuk University]

The two submitted impressive reports from different directions.

Shin Seo-jun added solid arguments that seemed to have been reviewed by an expert in an argument that showed an excellent understanding of basic legal principles and Han Seol incorporated an enormous amount of data into his writing that it is hard to know how he researched all of it in such a short period of time.

‘These are the kids who get good reviews from clients.’

When he saw the two pearls found in the mud a smile appeared on Heo Jong-il’s face.

Even though it was something I was told to do I had to provide some resources to make the work worthwhile.

In the end humans are creatures that cannot endure meaningless activities. Heo Jong-il was no exception.

‘Well… at this rate I think we’ve saved everyone we need from today’s portion.’

There were days when no one was rescued at all.

Considering the experience of the past few days if we rescued three people today would have been a very good harvest.

Of course that doesn’t mean he can throw the remaining applicants in the trash can without looking at them so Heo Jong-il clicked on the next application without much expectation.

    “…uh?”

    and.

    “Uh huh…?”

By the time he finished reading the assignment attached to the application he had jumped up from his seat and was running somewhere in a hurry.

    “This is not the time.”

The destination is the personal office of Senior Attorney Seong Jin-tae who is in charge of the intern selection process.

It was a few floors above Heo Jong-il’s office so I had to take the stairs.

“…I need to tell this to lawyer Seong Jin-tae right away.”

This is what made Heo Jong-il make such a fuss.

Senior lawyers are very busy people so they made people forget the obvious fact that they must check their absence by phone or text before going to meet them.

It was an assignment report written by just one law school student.

A knocking sound closer to a thud than a knock rang out.

    “…What’s going on?”

Seong Jin-tae who opened the door was frowning somewhat.

It was only natural that he came without warning and pounded on the door.

However Heo Jong-il who was excited did not notice this.

“Please take a look at this Attorney Seong.”

At the same time Heo Jong-il held up the report he had been reading a moment ago.

“Isn’t this… something I gave you as an intern selection assignment for this summer?”

“you’re right. But this is what it is about.”

Heo Jong-il said trying to control his excitement.

‘What on earth did I see?’

Heo Jong-il did not think that this task presented by Seong Jin-tae was that difficult.

However if you think about it the other way around it wasn’t such an easy problem.

The legal issues that can be discussed in the current situation have been determined to some extent.

In Heo Jong-il’s opinion there was no way to avoid all responsibility under the Serious Accident Punishment Act but it was possible to discover a few tricks to minimize responsibility.

If you get closer to the answer by going through data and general legal principles you either win or lose.

Of course since Seong Jin-tae does the final evaluation not you he might evaluate various factors other than how close the answer was to select the successful candidate. Anyway that was how Heo Jong-il saw it.

    ‘But what is this?’

The last report that Heo Jong-il opened was composed of content that completely shattered his common sense.

    – How to win at trial?

The report which started with a bold question answered itself like this:

    – It’s simple. You can go to trial when you can win.

A sentence that sounds like a Zen question.

When he first read this Heo Jong-il tried to throw this application away saying that it was completely nonsense because he couldn’t remember anything but the moment he read the next part he completely changed his mind.

    – The issues at issue in the case are… (omitted)… ultimately whether there was a violation of the obligation to ensure safety and health stipulated in Article 4 of the ‘Act on Punishment of Serious Accidents etc.’ and whether that violation was the cause of the industrial accident. This is what happened.

    – Regarding this the existing Supreme Court precedent… (omitted)… adheres to this position. However from the date of the relevant precedent to the present the terms of office of the Chief Justice and four Supreme Court Justices have expired and their appointments have been replaced and the terms of three additional Supreme Court Justices are scheduled to end soon. The list of potential potential candidates for those positions is as follows.

    – When referring to minority opinions and precedent reviews of Supreme Court precedents written by changed Supreme Court Justices and Supreme Court Justice candidates (Appendix Nos. 19 to 37) it can be confirmed that they are taking a completely opposite position on the issue than the Supreme Court Justices at the time of the ruling. .

    – In other words if the three remaining members’ terms of office end and the provisional candidates are appointed as Supreme Court Justices and are then tried in the Supreme Court it is believed that there is a high possibility that the existing precedent will be overturned.

‘What kind of idea is this?’

Heo Jong-il could not help but be astonished. The author of this report had no intention of being bound by the standards established by existing precedents.

On the contrary the current personnel composition of the Supreme Court is completely different from that at the time of the ruling and by analyzing the tendencies of the new Supreme Court Justices they came to the conclusion that there is a high possibility that they will take a completely different position from existing precedents.

    – Therefore we propose to use all possible means to delay the trial process until the terms of the three Supreme Court justices whose terms are currently expiring expire.

    – The specific methodology is as follows…(omitted)….

Then he came up with an idea that I could not even imagine a law school student with no practical experience of holding out while delaying the trial until a situation where the precedent could be overturned.

    – Of course these methods have limitations and countermeasures also exist. Possible countermeasures are as follows…(omitted)…

It even went a step further.

The trial delay methodology that this guy wrote was all part of the work manual that Jin & Ahn’s practitioners actually use and I analyzed it in my own way and wrote in detail the countermeasures that can be taken from the prosecutor’s perspective.

It was written in so much detail that it made me wonder if this was the part they had put the most effort into thinking about and researching.

Of course that couldn’t have been the case. I’m not an aspiring prosecutor trying to uncover the law firm’s dirty tricks.

Anyway he was a huge guy. Looking at the mindset alone it was to the point where it could have been put into practice right away rather than just being a desk hit.

If a first-year law school student had this kind of talent we should have stamped it as ours before taking it somewhere else.

“So this person must be selected unconditionally.”

“…What is the name of the student who wrote that report?”

    “Oh so. that is….”

Only then did Heo Jong-il realize that he had been so excited by Seong Jin-tae’s question that he had not even checked the applicant’s name.

Sung Jin-tae sighed after seeing him embarrassed and took the laptop from Heo Jong-il.

    and.

    “…ah.”

After checking the name written at the top of the report he groaned inexplicably and touched his forehead.
