I Became a Genius Law School Student Episode 7

The law library at Hankuk University Law School was equipped with a number of study rooms.

Many law students are sensitive to noises and movements made by others but they want to study comfortably with their legs stretched out.

Therefore there were not enough study rooms where one could relax comfortably and study while occasionally chatting with friends.

Hanseol also managed to successfully apply for a reservation despite fierce competition.

In the study room that was so difficult to occupy.

    “what. “Why is this wrong?”

Park Yoo-seung the number one student at Korea University was sitting across from her.

    “…Why are you here?”

“We’re in the same group. Let’s help each other live. “Won’t Jo Won have to study well to get good grades for the presentation?”

He subtly emphasized my contribution so there was no point in kicking him out.

“Don’t you know that it’s cool to not show off something like that?”

“A person who will become a lawyer should get into the habit of finding and using whatever advantage there is. “How are you going to win a trial if you know that failure is a virtue?”

“Ugh you didn’t say a word.”

    Han Seol pursed his lips.

It was true that I was thankful.

For her who had repeatedly achieved top honors wherever she went throughout her life losing the top honors in admissions to Shin Seo-jun was an unfamiliar shock.

Even his first test score wasn’t behind him.

To overturn this a lot of group scores were needed.

Whether it was a cow that caught a mouse while backing away or something else it was true that Park Yoo-seung gave the unlucky chief a punch and earned a point.

Therefore I was willing to tolerate the use of it as a study room.

    “Look where you are.”

    “uh?”

“He said he didn’t know why it was wrong. “I will take care of it.”

When she secretly held out her hand Park Yoo-seung’s eyes widened and he handed her the answer sheet he had been solving.

Hanseol took it and read it carefully.

“see. ‘A was driving an electric kickboard while drunk and hit and injured someone…’ However after that the Road Traffic Act was revised and electric kickboards were not considered ‘cars etc.’ under the Road Traffic Act but ‘personal mobility devices’ or ‘bicycles.’ “It is a matter that was classified as ‘etc.’ and the sentence was lightened.”

“In this case the issue is the motive theory of Article 1 Paragraph 2 of the Criminal Act. Since the revision of the Road Traffic Act is not the result of reflective consideration of the unfairness of the punishment the law before revision is applied and the punishment remains the same.”

    “…what?”

    “no?”

Han Seol was dumbfounded by Park Yoo-seung’s question.

“Are you kidding Park Yoo-seung? “The theory of synchrony has been abolished!”

    “…Huh?”

The ‘motivation theory’ was a theory about how to handle cases where punishment was not given or the sentence was lightened due to a revision of the criminal law after a crime occurred but before a final judgment was made.

Article 1 Paragraph 2 of the Criminal Act states that in such cases the new law must be followed.

However the previous Supreme Court precedent held that the ‘motive’ for revising the law should be examined first.

This means that the new law should be followed only when the law is revised with reflection that the punishment is unfair or excessive.

The problem was that this ‘theory of motive’ had no basis in the legal provisions even if one looked for it with ease.

The specific definition of what constitutes ‘reflective consideration’ was also ambiguous.

It was natural for it to be criticized as a baseless theory.

Then it was finally abolished due to a change in precedent around last year.

If you are a student studying law just before entering law school you would naturally have learned that the theory of synchrony has been abolished.

    “really?”

    “look. “It’s written here.”

When Hanseol showed him the latest edition of [Comprehensive Criminal Law] Park Yuseung looked at it in bewilderment.

Then he resolutely pushed the chair aside and stood up shouting.

    “…go.”

    “go?”

“Thank you Grandpa Supreme Court Justice! “This trash theory has finally been abolished!”

    ‘…He’s a really strange kid.’

    Han Seol burst out laughing.

If you think about it it was quite an amazing thing.

Park Yoo-seung whom I watched from afar while he was in charge of the Department of Business Administration during his undergraduate years was a real asshole.

Then he somehow got into law school and now sits at his desk for hours every day staring at law books.

Even during lectures don’t you always come early open your textbooks and prepare for class?

Some pointed out issues that even she didn’t know about and sometimes she reacted as if she was hearing basic information for the first time.

This is especially true for relatively recent precedents or changed legal principles.

‘It’s as if a ghost who died while studying for the bar exam a long time ago has haunted me.’

Of course Han Seol could not know that that was infinitely close to the truth.

    “It tastes good.”

Either that or not. Park Yoo-seung now rolled up his sleeves and eagerly began handing over the exam papers.

I was slowly getting used to studying law for the first time in a long time.

It seemed like the brain also had something called muscle memory.

In the first place law was originally just pouring water into a bottomless pot.

Because there was so much to memorize and it was so volatile it was not uncommon for me to not remember what I saw yesterday when I woke up today.

The only way is to keep pouring in water and filling it up faster than it can leak out. And that was my specialty.

“I had no idea that so many precedents and legal principles had changed in the meantime…”

It’s not like he was reincarnated in reality but rather he was possessed in the webtoon world but this part was also reflected very well in reality.

Since I stopped studying there have been quite a few cases added.

To be honest just looking at the amount it felt like there was a lot more now than when I was studying for the bar exam ten years ago.

So it was even more fun.

    “You came early today too?”

“139th place. “You have to work hard to keep up.”

Before the lecture started as always I opened the textbook for today’s class and was preparing for studying when Hanseol arrived.

“…You’re not paying attention to what he said back then are you?”

“Him? “Oh what is that boat?”

“Studying is a mental battle. There is no need to listen to those who try to criticize and shake things up. “Don’t overdo it and go at your own pace.”

What is this? Are you worried?

In the original I didn’t know because I only saw him being so stiff but Hanseol was surprisingly the type with a lot of stoicism.

Actually I was already at a point where I couldn’t even remember the name of that ship so it was a useless worry.

If I had to be honest I was a bit concerned about the last comment about ‘earning points is over’. What on earth are you trying to do?

“Today the corporation is responsible for its illegal actions. The requirements are ‘dae’ ‘jik’ ‘bul’ ‘dae’ ‘jik’ ‘bul’….”

Hanseol who was sitting next to me immediately opened the same page as me and began memorizing acronyms.

When memorizing the periodic table of elements it was similar to chanting ‘Suhelibeboran nitric acid…’

About ten minutes later as the lecture began students flocked in.

At this time the classroom becomes so lively that it reminds me of my undergraduate days in college.

‘No actually there is no difference.’

If you say you graduated from college and are attending a professional educational institution called law school it makes you feel like you’re an incredibly adult.

But in reality that wasn’t the case.

Most of the people sitting here are so-called ‘college graduates’ who entered law school right after graduation without even experiencing social life.

This means that my mental age is no different from when I was an undergraduate student.

Even when I was in college I just gritted my teeth and studied so in fact nothing much changed compared to when I was in high school.

While reading ‘In the Law School’ I thought that the characters had a very childish side but after meeting them in person including Bae Wakgi I realized it clearly.

    These are just kids.

It would be perfect to go beyond the 3rd year of high school and call them 8th and 9th.

I once again became curious about whether real-life law school students are like this.

    “Now let’s take roll call.”

Professor Park Soo-geun who is in charge of civil law lectures began calling students by their names.

    “1 trillion. Kang Doo-seong.”

    “yes.”

    “Yoo Taewoon.”

    “yep.”

Flowing and flowing it’s our group’s turn.

    “10 trillion. “It’s a rumor.”

    “yes.”

    “Park Yu-seung.”

    “yes.”

    “Iharu.”

    “….”

As always there was no answer. Hanseol looked at the seat next to me and sighed softly.

    “Is he never coming?”

    “Maybe so.”

    “Whew.”

“No problem. “Because you always make more than two servings.”

    “that! crab! “It’s a problem!”

In fact it’s not ‘maybe’ but this person called Lee Ha-ru does not appear throughout the pre-season.

Even after the regular semester begins he rarely appears in the work and it is not until the midterm exams of the first semester that he makes his grand debut by dropping a huge bomb on the script.

‘Well that’s something to think about later.’

In the first place Shin Seo-jun handled the bomb himself so it’s not a problem I should worry about.

There is no problem with group presentations and Q&A since we (mostly Hanseol) do our best.

All I had to do was pretend that I was a non-existent person and continue working hard as I was doing.

“ruler. “Today… it’s time to take responsibility for the corporation’s illegal actions right?”

Professor Park Soo-geun opened his mouth.

“First of all what is a corporation? “Who wants to answer?”

    Hanseol suddenly raises his hand.

“It refers to a being that is not a person but is recognized as qualified to become a ‘subject of rights and obligations under the law.’”

“Well said. In civil law people are considered to have legal personality from birth and are subject to rights and obligations. In other words we call them natural people.”

Professor Park Soo-geun looked around the audience and continued.

“On the other hand there are beings that are not originally human but have decided to treat them like humans due to various realistic needs. “That is a corporation.”

Since it was a basic question there were no plus points.

A regretful feeling left my appetite.

“For example let’s consider a company. Running a company costs a lot of money right? We will receive investments and in some cases borrow money. “Then who should the creditor who lent money to the company receive money from?”

Professor Park Soo-geun continued the explanation.

“To the boss? Then creditors become very anxious. “If it’s money to be moved by a company you’re lending a very large amount of money so what do you do if you lend it to someone trusting their face and then they run away?”

To prevent this from happening some kind of safety device is needed. The problem is how to provide it.

“Then how about making it available to all members of the company? Creditors may feel reassured because they have insurance but this would be too harsh on employees right? “He didn’t borrow anything but he ended up becoming my debt…”

Professor Park Soo-geun added that after such deliberation the compromise was ‘corporation’.

“So what if the company itself had legal personality and could own property and take on debt in its own name? “Would you like the student to answer that question?”

“Hmm… wouldn’t it be possible to trust the debtor a little more? “After all the company is in debt.”

“That’s correct! “It’s easy for creditors to receive money from assets in the company’s name later and as long as the company doesn’t go bankrupt there’s less anxiety about default.”

This is a basic but easy-to-understand explanation.

In fact if you are only focused on the exam there is no opportunity to pay attention to basic concepts and the purpose of their introduction.

This is because there are no cases where you appear directly on the exam.

Therefore it is omitted in many exam books and is often not covered in commercial lectures.

    ‘But it’s a necessary process.’

If you know the intent and purpose of legislation in many cases you can see the conclusion without having to memorize precedents.

For example among legal provisions related to corporations precedents are often interpreted in a particularly favorable light to the other party.

Such as registration of restrictions on representation rights or job-relatedness of liability for illegal acts…

If you don’t know the reason you have to memorize what to interpret to someone’s advantage. Naturally the burden of memorization is bound to increase.

However if you know that behind the system of a corporation is the purpose of safety and convenience of transactions everything is neatly organized like a puzzle.

Therefore it was a very desirable teaching method to go over this basic purpose once in a while in a first-year lecture or even in a pre-school class.

Although this is my personal opinion.

“…So this is it. Anyone have any questions?”

Professor Park Soo-geun who continued to move forward with the day by explaining various concepts in an easy-to-understand manner asked at the end of the class.

Because it was a clear lecture no one asked questions.

“Okay then. I assume you understand everything. “Shall we take time to solve group problems?”

    It has come.

Next to me Hanseol stretched out. In our group there are 9 out of 10 rumors going around.

I’m still filling in the holes in my knowledge and there’s almost nothing Hanseol doesn’t know as long as it’s covered in Freero.

Sometimes when she was the only one out I would sneak out when I felt like I was being noticed.

Hanseol scores. I cheer and sometimes pinch hit.

It was a perfect division of labor.

“The division of labor is nonsense….”

It was the moment when Hanseol complained.

“Oh I have something to announce.”

Professor Park Soo-geun scratched his head.

“Well… I’ve heard complaints that since the current group evaluation method only requires one member of the team to do well there will be people who receive unfair points just because they did well in their group.”

    Wow.

“So I’m thinking of changing my approach a bit.”

The new method that Professor Park Soo-geun talked about was this.

From each group a person randomly nominated by the professor comes to the front.

Next the problem to be solved is revealed.

Each student solves the problems assigned to them and receives comments and feedback from other students.

If you answer correctly or defend your point well you will receive additional points. If there is an area that is not satisfactory you will receive points deducted.

All additional and deducted points received by each group member are immediately added to the group score.

In theory no matter how good a group member is and earns points if the team member who is not good gets beaten up it is a total loss.

“Oh and. These additions and deductions will also reflect individual attendance scores in the future. “Attending class was the most basic thing and we received strong protests demanding that we do so.”

Of course there is a principle of non-retroactivity in the law so it will not be reflected until today. From tomorrow.

    Professor Park Soo-geun added that.

Hanseol and I’s gaze automatically turns to the side.

The seats assigned to the 10 ghost group members have been empty every single day since the first day of the free program.

And then in the air our eyes crossed with someone who was looking at the exact same place.

    “Puhup.”

Bae Hyeon-joong was looking this way and bursting out in laughter.

    …Hehe look at this guy.

In fact I was relatively tolerant of the characters in this world.

As I said before they are just ‘kids’ who studied for a few more years.

There is no point in getting seriously angry and fighting emotionally.

So even when Bae Hyun-joong openly started a fight I just gave him a slap in the face.

    No you’re pitiful.

He can’t forget the woman he dumped so he waits for her to get married.

But in this case the story is different.

He couldn’t stop at just sulking and making jokes so he tried to use tricks to harm me directly.

In particular I was very offended that they had made a claim based on attendance scores knowing that there was a ghost member in our group.

Fortunately the professor gave me a reprieve so I haven’t really suffered any damage yet.

But this was an act that crossed the line just by trying.

…It seemed necessary to give a proper warning at least once.
