I Became a Law School Genius – 42

I Became a Genius Law School Student Episode 42
“I’m sorry for looking sideways at you. But that hood is the hood of Hankook University Law School right?”
It was as pointed out by the short haired person.
Originally Park Yoo-seung was very proud of being admitted to Hankuk University Law School having passed through incredible luck.
I don’t know if that’s why but there were several law school sweatshirts and hoodies in his room.
Since it was such a comfortable outfit I wore it without thinking much but since it was a central library full of undergraduate students it seemed to have suddenly attracted attention.
I thought denying it was funny so I nodded obediently.
“Yeah whatever. “It is as you said.”
“Wow it’s real….”
An exclamation came from behind.
“I will definitely follow you next year!”
The well-built guy clenched his fists.
As law school entrance exams have become more difficult entering one’s own law school has become no easy task for undergraduate students at Korean universities.
From what I heard the proportion of graduates who go to other law schools in the Seoul area or the provinces is also high and there are also many people who do not get the passing score or get into places that do not meet their grades so they take the third attempt.
Therefore the sign “Hankook University Law School” had already become something of a dream for undergraduate students here.
Since most of the graduates advance into public service or large law firms it is no wonder that it is considered a guarantee of success.
‘It’s a bit shameful to think that way.’
Haven’t I become like someone who wears a law school hoodie to show off in front of my juniors?
‘I didn’t get it through my efforts in the first place.’
The results I achieved here are purely the result of my abilities.
However the admission itself was already done the moment I was possessed so trying to make it up would only be a shame.
“Anyway there are a lot of unresolved issues while we are studying but we have no one else to turn to… It would be great if you could help us…”
The short-haired man blurted out his words in a sad tone and now all four of them were staring at us with bright eyes as if they had met their savior.
I gently put the half-read book down on the desk.
It was a good thing.
If you are not in a condition to study in earnest and the bond law is only covered in lectures taken by undergraduate students questions you can ask about will be limited to basic areas.

It seemed appropriate for a body warm-up or rather a brain warm-up.
Therefore I was happy to answer.
“Of course it’s not difficult.”
“!”
All of a sudden the faces of the group of undergraduate students turned bright red.
“But what will you do for me if I help you?”
With a clue.
“Uh… yes?”
The short-haired female student was embarrassed.
“I heard it at first glance. Are you all law school students? “That’s why I listen to the Property Transactions Act.”
“yes that’s right. So I wanted to get help somehow…”
“If you want to become a lawyer.”
I asserted.
“It is better to give up the habit of relying on good intentions without compensation.”
A lawyer must be able to think legally.
To put it in a good way legal thinking means being well-informed but in a bad way it means being petty and picky.
Isn’t the essence of a lawyer’s job ultimately being to create a balanced state by comparing gains and losses and weighing the severity of faults?
If you want to gain something you must be prepared to give that much.
A just and fair contract.
Exclusion of gain without cause.
That is the basic idea of civil law as contract law.
“The property transaction law that you are taking is ultimately a subject in which you learn that.”
This is the essence of what you want to know.
“Oh….”
“I never thought about it that way.”
“Then what should I give you?”
The four undergraduates were amazed and then put their heads together and began to seriously think about what to pay.
“Well I’m telling you to think about it. It’s not like I’m really going to get paid for it.
Only then did I smile and wave my hand.
“When you become a law school student in the future and meet a junior who is having trouble studying like you are now please help them. “That’s all.”
“Senior…!”
There is nothing wrong with having more talented juniors. Who knows maybe the seeds sown like this will come back in a good way later?
“So what part was difficult for you?”
“This is it.”
When I asked the short-haired man held out a bundle of paper.
From the looks of it this guy seemed to be the leader in this group.
Although I am a bit weak I do not dislike people who are confident and assertive.

“Let’s take a look. “Is this… an OX problem?”
[16. Even if B forged documents and registered the transfer of ownership in his own name as if he had purchased land Do—–(X)]
As I was reading the problem the short-haired person started crying.
“I don’t know what this question is asking or why the answer is X. First of all since it is said that it was ‘believed to be true’ I think it will be protected as a bona fide third party like other provisions….”
“The professor is a bit evil.”
“yes?”
“This is not a transaction law issue.”
A wicked conman sold someone else’s land using fake documents.
Can the poor victims who were deceived without knowing anything be protected?
To an outsider this issue can be read in that sense. But that’s not the point.
“Article 110 of the Civil Code. A declaration of intent made under fraudulent duress may be cancelled. The remedy for fraud is cancellation of the transaction not vesting of ownership. “Articles related to trading activities have little to do with this issue.”
Rather the core of the problem is a completely different concept.
“This is a question of the credibility of the registration. This is a concept dealt with in real property law.”
Probably never taught.
Do you have any sense of understanding because something that is neither within the scope nor taught is inserted between the problems?
It was natural that no answer could be found even after looking through the lecture materials.
“It’s not that you can’t solve it because you’re stupid.”
“So what about this?”
Short hair pointed to another problem.
[29. If a gift contract is entered into in return for an affair the contract is invalid and the person receiving the gift must return the item received as a gift to the other party ——(X)]
“Because a contract in exchange for an affair is an anti-social contract isn’t it invalid under Article 103 of the Civil Code? “If it’s invalid I have to return it!”
Civil Code Article 103 (Legal Act Anti-Social Order) Any legal act involving matters that violate good morals customs or other social order shall be invalid.
In civil law there is a principle of freedom of contract.
In principle a contract entered into by mutual agreement between people is valid and its contents can be freely determined.
In a liberal democratic country the government or authority does not interfere with individual actions.
However this does not mean that even contracts containing wrong content such as contract murder or prostitution can be recognized as valid.
The ‘gift in exchange for an affair’ mentioned in the question is also a typical anti-social order act and is therefore invalid.
So the point about short hair was at first glance valid but I shook my head.
“If the contract is invalid due to violation of Article 103 Article 746 of illegal cause benefits applies so the compensation already provided cannot be returned. Don’t even enter into such a bad contract in the first place. The idea is that it won’t guarantee any rights. …But I don’t think this is the scope either.”
We’re only just about to take the midterm exam and ‘unlawful benefits’ is a concept found in the unfair enrichment section which is quite late in the bond law.
Unless you are going backwards there is no way you would have learned it already.
“The problem is a complete mess.”
“So that’s what it was….”
Undergraduate law courses do not cover too much in-depth content.
I tend not to include difficult precedents and only present situations that can be resolved at the level of ordinary provisions and basic legal principles.
However this meant that there was no way that excellent students attending Korean universities would not even understand what was being said.
The problem was also with the lecture materials.
It seemed like a mistake that came about because the professor was too lazy to create new data every year and was trying to piece together what he already had.
“By any chance who is the professor in charge?”
“This is Professor Seongcheol Choi.”
“Hey are you that person again?”
Since undergraduate classes had nothing to do with law school performance it seemed like I was only doing them half-heartedly.
For Choi Seong-cheol this was obvious even without looking at it.
After that I answered various questions from four people.
As in the previous two cases there were problems that were out of scope to begin with and there were also parts that required supplementary explanation due to poor understanding of basic concepts or legal principles.
“thank you! “I learned so much!”
When we parted ways all four of us bent our waists at a ninety degree angle and bowed.
I was just making a fuss as if I was doing rehabilitation training for not being able to study well anyway but I received so much gratitude.
On the contrary I was almost embarrassed.
“It looks like the clogged blood vessel has been unclogged brother! “How can I repay this favor? There are a lot of good kids in our department so maybe we can go on a blind date!”
“Oh what nonsense for someone so busy!”
The guy with a good physique who was already calling me his older brother the moment I saw him was grabbed by the ear by someone with short hair and dragged away.
After all that side is probably closer to nature.
I also waved at them then turned around and headed home.
If fate meets you you may be able to see him as a junior later on.
I prayed in my heart that I would work hard and achieve my goal.
“Now that I think about it it seems like my dyslexia has been cured.”
Even in the morning letters were jumping out of my eyes and while I was explaining things to them I showed them the scanned copy of the exam and looked up the laws but I didn’t experience any abnormalities.
After all teaching others was the easiest and most enjoyable way to study.
Teach….
A good idea suddenly occurred to me and when I returned home I opened my laptop.
