I Became a Law School Genius – 41

I Became a Genius Law School Student Episode 41
Small sighs were heard from everywhere.
“ah.”
“no.”
“What is this….”
It was not at all strange for them to act as if they had been slapped.
Because the test questions we face today are a million light years away from today’s style.
[Question 1. Read the following facts and discuss to the best of your knowledge the legal relationship between A and A. do)]
‘Discuss what you know.’ I can’t help but sigh at the vague order which feels like I’m taking a civil service exam from the Joseon Dynasty.
but….
[Party A borrowed 300 million won from Party B on March 28 2002 and borrowed 300 million won on March 29 2002 to secure it. A mortgage was registered on land X owned by Party A. However A has been building Y building on X land since March 3 2002…(omitted)…
However on September 14 2002 Party A sold land ..(syncopation)…]
‘It’s a familiar fact.’
This question was copied almost verbatim from Jeon Gyu-wan’s research material on bar exam questions.
Of course the detailed facts such as specific dates and types of registration were slightly modified.
However even then only the conclusion was slightly different and the issues asked and the logical structure to be extracted were almost similar.
Even if that’s not the case this is a very advantageous testing method for me.
For general questions for example ‘Is Party A’s defense that this contract is an abuse of representative power valid?’ there are almost no people who do not know what to write in a question such as this.
The score is only determined by the abundance of precedents and legal principles that serve as the basis for detailed arguments and whether the conclusion is correct.
On the other hand in problems like this the difficulty is finding out what is being asked in the first place.
Students who have studied well will have a plausible framework to some extent but some of the issues that must be written down will inevitably be omitted.
‘That’s the point where I get points.’
It was my specialty not to omit issues.
Even if individual issues are handled somewhat poorly they are identified and transferred to the answer sheet without missing a single issue.
Ultimately since points are allocated on an issue-by-issue basis it is easy for this side to score high.
‘Let’s see…’

I read the question carefully underlined a few places and then nodded.
‘The burden of statutory land rights of the mortgagee the independence and attractiveness of the property right the scope of return by the bona fide possessor when exercising the right to claim return of the property the progress of prescriptions for the right to claim registration and the request for transfer registration for the recovery of true title… Is this the extent of it?’
Write down the selected issues in a row in a corner of the test paper and evaluate their importance.
In these problems there are a lot of issues to cover but the amount of answer sheets and test time are limited so deciding where and how much description to invest was also a skill.
‘Legal land rights? This is a side issue in this matter. I’ll skip the generalities and just give you a line about precedents. Considering the scope of this exam and Jeon Gyu-wan’s usual teaching style you need to write the registration claim section in more detail.’
I had a rough idea of the answer in my mind.
Then there is no time to waste.
I immediately picked up a pen and started writing down the answer.
My classmate who was sitting next to me and holding his head looked at me in confusion.
“Please don’t turn your head to the side. There is a possibility of fraud.”
With the instructor’s sharp warning the guy went back to holding his head.
Using the sound of his sighs as background music I continued to play with the pen.
“Hey how was your test?”
As soon as the exam was over Hanseol with a pale complexion came running to me.
“Well okay.”
“Anyway…? That? “It was a perfect bar exam question!”
‘So I’m saying it’s okay.’
In fact I was almost confident that I had written it perfectly but there is nothing more uncool than being arrogant when the results are not yet available.
Rather it seemed like he was showing humility but Hanseol shook his head as if he was shocked.
“I have doubts sometimes.”
“What are you talking about?”
“Actually the real Park Yoo-seung is already dead and I have a suspicion that what I’m seeing is someone else who is possessed by the evil spirit of Jang Su-saeng for the bar exam.”
‘Hot.’
It may not have been a serious statement but it was a remark that made me sweat a little.
“Don’t be harsh. “It would have been well written anyway.”
“no. “You missed two issues.”
“Good job.”
For first-year students who were just starting to adapt to law it was too harsh a request to find all the issues in this problem.
In reality it was best to write as clearly as you could even if you missed some points.
With such certainty no one can match Han Seol.
I would have probably submitted an answer that was equivalent to a complete copy of the textbook only for the parts I had written.
That’s enough to get a high score.
Most of the students missed more issues than the one essay but the content was also poor.
“You might be anxious because it’s your first time failing to write something on a test. But that’s what law exams are all about. “Usually out of 100 points seniors get about 6 to 70 points which is an example.”
“Is that so…?”
“Well I found and wrote everything without missing any issues.”
“hey!”

Although I say this the difference in scores between me and Hanseol is probably not that big.
Although I wrote down all the issues for which points were at stake I omitted many of the detailed descriptions in terms of volume distribution and Hanseol would have taken all the details that could receive additional points.
I left Han Seol who was sulking and went out to rest for a while.
In a few hours I will take the Civil Law I exam again and tomorrow I will have the Criminal Law I exam.
The next day is the Constitution and then the International Trade Act which is an optional law.
Since I had to run a full schedule for a total of 4 days I had to take breaks in between when I could.
‘okay. The test has only just begun.’
Luckily Civil Code III was presented in a way that was favorable to me.
However there was no guarantee that this would be the case for other subjects as well.
Even if someone suggests that this midterm exam be unified in the style of the bar exam there is no way that would happen unless they decided to do so.
That’s why I didn’t relax at all until the last subject was over.
however….
[Question 1. Please review each person’s guilt (however there is no need to consider special criminal laws but they may be subject to additional points as part of a more comprehensive review).]
“uh?”
Criminal law I.
[Question 1. Review all defenses that Party A may raise.]
“Huh?”
Civil Law I.
[Criticize the following Constitutional Court decision.]
Constitution I.
“Uh huh?”
Why do all subjects only have questions that everyone knows?
* * *
The four-day exam period passed in the blink of an eye.
Of course the hardships of the process were not something that could be expressed in such a short sentence.
Every day I would only open my eyes for an hour or two struggling to see at least one more letter and my hand muscles would cramp from writing down answer sheets over and over again.
‘I heard that real law schools now take exams on computers….’
However the background of the story was from a time before that.
I had no choice but to write all the answers by hand.
In the end when the test was over both my body and mind were in tatters.
Still what’s over is over.
It was hard but it felt like it went by faster because I focused so hard.
“Everyone worked hard.”
Finally after completing the selection test I exchanged greetings with the study members gathered in the student cafeteria.
“Well there’s no need to have an after-party right?”
When I asked for confirmation Lee Haru answered in a voice that was on the verge of death.
“I can’t feel it. “I plan to collapse and sleep.”
“I’m going to go home and rest too.”
“I don’t even have the strength to lift a finger….”
“It wasn’t this hard even when I stayed up all night writing an article haha.”
A company dinner to celebrate the end of exams was a luxury. Everyone was in rags after a forced march and most of all they desperately needed to recharge.
Thanks to this I also returned home alone after parting ways with them and enjoyed a long break.
I overslept a lot and was lazy by lying on the bed all day.
In times like this if you don’t rest properly your mind and body will break down at a really important moment.
‘It’s the so-called burnout.’
I was the one who ended my previous life with death from overwork.
The importance of proper rest was engraved in my heart more than anyone else.
Therefore I planned to spread out and do literally nothing for at least the weekend of the week after the exam.
‘…But I’m starting to feel itchy.’
However after taking a day off on Friday when Saturday came my soul which was not used to a life of doing nothing began to complain of boredom.
I really couldn’t be a terrible workaholic no a studyaholic.
I decided to take a break but before I knew it I was automatically sitting at my desk.
“Oh I want to study.”
It was a monologue that anyone who heard it would point out that he was crazy.
But what can I do if I was born like this?
I opened the thin workbook to warm up and look at some multiple-choice questions.
“Oh.”
But I can’t see the letters.
“I can’t read it…?”
It seems that it took more energy than I thought.
Long complex legal texts couldn’t be digested and bounced off my head.
I felt like I needed to rest a little more to recover my condition.
However it was worse to sit around and do nothing.
Whether it was during my time as a test taker working to pay off my debt or after being possessed.
The hard work that had become a habit was rejecting laziness.
“Should I at least go to the library?”
Instead of the law school library I planned to go to the undergraduate central library and read some light novels to kill time.
Reading mystery novels has been my hobby since my previous life.
Borrowing books from the public library was one of the few leisure activities that could be enjoyed without spending money.
The Central Library we headed towards was quite crowded.
Since the law school exam period is about 1 to 2 weeks earlier than the undergraduate exam period it seems that the undergraduate students have only just started preparing for the exam.
I borrowed an appropriate book but the reading room was already full.
I had no choice but to go to the book cafe next to the library and take a seat.
Here too most of the tables were filled with students studying individually or doing group work.
Rather reading while drinking coffee with the sound of chattering in the background had its own charm.
“Oh what should I do? “I just don’t know…”
“Searching also has its limits. “I don’t understand the lecture itself.”
“Who asked me to listen to the Property Transactions Act? “Is this really going to help me get into law school?”
A conversation taking place next to me suddenly caught my ear.
“Where is the crazy professor who gives group assignments a week before the exam?”
“I know. In fact we don’t know anything because they just talk about what they want to say and leave the class. “How do you do a task like this?”
“Is there someone who can teach me? “I lost contact with the senior who got an A+ last year while retaking the law school entrance exam…”
A group of undergraduate students consisting of two women and two men were putting their heads together and suffering.
Property transaction law is a course taught at the undergraduate level that combines some of the general provisions of civil law and bond law.
Since the establishment of law schools undergraduate law schools have been abolished at all universities that have received law school accreditation.
However even law lectures as a liberal arts subject did not completely disappear.
Recently as competition for entrance exams has intensified I have heard that there are many students who take at least undergraduate law courses and submit their credits as specifications.
‘In fact in my time even law students didn’t even listen to the classes.’
Most people who dream of passing the bar exam would openly memorize the exam book they bought at a private academy even during lectures.
Considering that one of the purposes of introducing a law school was ‘normalization of university education’ this may be a positive change.
Anyway these students seemed to be having a hard time because of the difficult assignments in their law class.
Especially when it comes to bond law it is bound to be difficult to understand the concept without someone properly explaining it.
The moment I picked up my coffee cup cheering on my juniors whose names I did not know.
“for a moment.”
Among the group a girl with short hair suddenly looked at us.
“Isn’t that the hood of our law school?”
‘Oh.’
“It’s real.”
“It must be the scale symbol on HNU.”
“Wow crazy. I’m jealous… I wish I could go to our school’s law school.”
As the well-built male student muttered the short-haired man who had first been lucky gave him a reprimand.
“Oh you bastard. “Are you drooling out of envy right now?”
Then she got up from her seat and came towards me.
“Hello senior!”
It was a very bright and cheerful voice completely different from when he was berating my friend just moments ago.
“We’re having a bit of a difficult time studying so could you help us for a moment?”
