I Became a Genius Law School Student Episode 4

    “It’s 339800 won.”

I was handed a heavy book bag from the clerk.

The reason I stopped by the bookstore early in the morning is simple.

This is because the only law book in Park Yoo-seung’s room was a book on civil law.

There is no denying that test books are effective for studying.

However in order to properly understand and apply legal principles you need several basic books to look up and supplement whenever you get stuck.

[Civil court principles – Written by Jiyeonrim]

    [Summary of criminal law]

[General Introduction to Criminal Law – Written by Kim Seon-don]

[Special Theory of Criminal Law – Written by Kim Seon-don]

The titles which gave off the scent of a gosi village in Sillim-dong made me smile with joy.

When I took the first test I realized that I was really lacking a lot.

I hurriedly looked through my exam book to prepare but it was impossible to cover the entire scope of civil law in just a few hours.

I had no choice but to skip all the multiple choice questions.

Instead I focused on case-type that is subjective problems that could use the law code.

This is because you can solve the problem by looking at the condolences and tracing your memory.

Even so I couldn’t remember the exact wording of precedents or the concepts of lectures so most of the answers were vague…

Fortunately the last question was a type of trap I had encountered countless times during my time as a test taker so I was able to write a conclusion reflexively.

Last night when I returned to Park Yoo-seung’s room I filled in the gaps in my memory all night long by comparing the test papers I had brought with me and the ‘Civil Law Knot’.

I also found and organized the list of books I needed to study one by one.

There was nothing else to do or people to meet anyway.

This is because Park Yoo-seung had a reputation at Korea University as a guy who had no answers since his undergraduate days.

For example he came into the classroom drunk and hit the professor with a pointer or attacked a new student got into a fistfight with her boyfriend and ended up in detention.

He was so vicious that there was no student at Korea University who had not heard rumors about him.

Therefore a person with common sense would not want to hang out with Park Yoo-seung.

His ‘friends’ who lacked common sense were ambassadors from my side.

In other words the person I am now is like an isolated human island where no one approaches.

“Well it’s nice to be able to buy books with peace of mind.”

It was a large amount of money that I would not have dared to spend in my previous life but compared to the money accumulated in Park Yu-seung’s account it was nothing more than dust.

I left the bookstore hugging the bag of books with satisfaction.

The second day of the free trial will begin soon.

    I had to hurry.

    * * *

    [Free class A classroom]

Starting on the second day the course will be divided into three classes of 50 students each.

It was natural since it was impossible to cram 150 people into one classroom.

The class Park Yoo-seung was assigned to was Class A.

He is in the same group as Shin Seo-jun Han Seol and Jeong Min-sik the main characters of the original work.

I open the classroom door and enter.

The eyes of the students who came first were focused on me for a moment but then quickly looked somewhere else as if they had seen something they couldn’t see.

Some people were looking at my face and whispering something among themselves.

A wry smile naturally appeared in the chilly air.

Among the new students at Hankuk University Law School approximately 100 are graduates of Hankuk University law school.

There are at least a hundred people who have heard of Park Yu-seung’s notoriety.

Most of the students from other faculties had interacted with Korean students at entrance exam institutes or joint law societies.

On the day of the opening ceremony one day was more than enough time for the graduates of Korea University who had discovered the worst bastards in their school to warn their friends from other universities in the main auditorium.

Of course there was no need to worry.

I am not Park Yoo-seung but I cannot and should not prove this.

And anyway studying was a lonely battle that I had to do alone.

The cold stares from those around me were as insignificant as dust compared to the dreamlike situation of being able to study law once again.

I checked the seating chart posted at the front of the classroom and walked to my seat.

The three people around you on this placement chart will be your group during this free-ro period.

Of course according to the original work we already know who Jo Won will be.

    “…what.”

The person sitting next to the seat with my student number was none other than Hanseol.

    “Why are you here?”

    Han Seol’s expression suddenly crumpled.

    “Because this is my place.”

    “You… here?”

I counted the seats with my fingers as if I didn’t want to believe it. However there was no way the ending that had been decided from the original work would have changed. After squinting her eyes for a long time she soon realized the tragic fact that she and I were in the same group.

“No it can’t be like this….”

Han Seol and Park Yoo Seung were classmates in the Department of Business Administration.

Therefore Han Seol knew very well that the rumors about Park Yoo-seung were not exaggerated and that he was a trash with an empty mind beyond imagination.

It was beyond her common sense to understand how such a person could graduate from the same university and go to the same law school as her.

Hanseol who was holding his head suddenly lifted his head.

    “Park Yu-seung.”

    “why?”

“I won’t ask you to work harder. I don’t expect anything like that. Just… I’ll take care of everything. Just don’t cause an accident. “Please do me a favor.”

The expression on his face was quite desperate.

According to the original story at this time Hanseol was determined to take first place in freestyle.

For her who had always been the best losing the top honors in admissions to Shin Seo-jun was her first loss in her life.

In order to get revenge I had to get the best grades on both the exam and the group evaluation.

However Park Yu-seung feels insulted by Han-seol’s request and causes a disturbance in the classroom.

Shin Seo-jun who arrived at the classroom just then overpowers him and rescues Han-seol.

It was the beginning of something different mixing into the one-sided rivalry.

Of course I am not the real Park Yoo-seung so I have no intention of being involved in such a childish skit.

    “okay.”

    “…really?”

“Now that I have come to law school I plan to change my mind and start anew. “At least I promise I won’t hold you back.”

Han Seol looked suspicious at the answer that was so obedient.

you? A fresh start? The message of disbelief was written all over my face but it was none of my business.

    Believe it or not.

    “Phew….”

Anyway Seol exhaled as if he had been sitting there for an hour.

“There is no need to feel pressured. I think I can solve most things on my own but if I can’t decide I’ll try collaborating with the rest of the team. “You won’t have to do anything.”

Hanseol’s voice brightened slightly as if he had found a sliver of hope in the abyss of despair.

    But Hanseol doesn’t know.

One of the ‘remaining team members’ she was looking for was currently sleeping comfortably in the dormitory and was not expected to show up for a while.

    ‘I’m afraid it’s just me.’

Of course I have no intention of holding Han Seol back. Because I promised that.

    okay.

I don’t mean to hold you back.

    * * *

    Criminal law.

First class time. A middle-aged professor dressed in a stylish suit suddenly wrote two Chinese characters on the blackboard.

    “Nice to meet you.”

    No one expressed any doubt.

If you are a student entering Korea University Law School there is no one who does not know who he is and what he does.

“This is Professor Jang Yong-hwan who will teach you from now on. And this is what I am going to teach you.”

Jang Yong-Hwan. Former chief prosecutor. The god of criminal law who is no different from a guaranteed check that turns his students into prosecutors.

Several students gulped and swallowed their saliva at the intimidating feeling that the name gave.

“Do you know what criminal law is?”

Han Seol suddenly raised his hand.

When no one else showed up for class to begin she held her head again and expressed her firm determination that she would score points on her own.

In the future if I know something I will probably try to appeal as much as possible.

“Okay student who raised his hand.”

“It is a law that regulates criminal acts and all punishment laws for them.”

“You memorized it well. “What’s your name?”

    “It’s a joke professor.”

“good. As student Hanseol said criminal law is a law that defines what a crime is and how and to what extent it should be punished. So those of you who study criminal law only need to know how to judge that.”

    Is this a bad thing?

If it’s a bad thing should it be punished?

If punishment is to be imposed to what extent should it be done?

“Simple right? But the things you have to consider to make this simple judgment are by no means trivial.”

Jang Yong-hwan said that and wrote a new Chinese character below the first two letters.

    General theory.

“Here we learn basic concepts and general legal principles for criminal judgment. “In most law schools it is taught in the first semester of the first year.”

Again the two letters below that.

    Each theory.

“Then we learn the definitions of the subject action and object that constitute each ‘crime.’ “It usually corresponds to the second semester of the first year.”

    Jang Yong-hwan continued.

“The vast majority of you probably never studied law in undergraduate school. If you have barely studied civil law before entering school you are in good standing and if you have studied general criminal law you are a very excellent and sincere student. How about the details? “If there’s a guy who came all the way there he’s definitely a pervert.”

    The students laughed.

It wasn’t because Jang Yong-hwan’s words were funny but because I felt reassured by the message.

‘It’s not that I didn’t study particularly well. The kids sitting next to me are all similar and the professor knows that too.’

So at least during this free trial we will take this into account and proceed slowly. They had come to that conclusion on their own.

    “Okay then.”

But that was a ridiculous illusion.

“Please answer without fear of being wrong. “Anyway what you don’t know the person sitting next to you doesn’t know either.”

The faces of the students who sensed something strange going on were about to harden.

“It’s time for your first group evaluation.”

With a crackling sound the beam projector shot light onto the blackboard. A screen of light was overlaid on the dark blue-grey surface.

There was about a paragraph of text floating around there.

    – ‘A’ is a college student who enjoys using community apps on campus.

    – While cleaning the school’s vacant lot he found a piece of trash on the floor. It contained an accusation that student council president candidate ‘B’ had cheated on exams and assaulted other students.

    – Accordingly ‘A’ uploaded the contents of the above gossip to the school community with the purpose of making the truth about ‘B’ widely known and making a desirable election happen. As a result ‘B’ lost the election.

    And Jang Yong-Hwan asked:

“ruler. “What is the issue in this case?”

When I glanced to the side Han Seol’s complexion was pale.

Of course her strength is her overwhelming memorization ability.

Although he was able to answer any questions within the scope of his studies he did not have the flexibility to solve unfamiliar problems.

And this question was explicitly asking about knowledge of the various aspects of criminal law.

Hanseol is a monster of sincerity who has studied not only civil law but also general criminal law but it was impossible for even her to digest the details.

Actually it was the same for me.

There are a total of 372 articles in the Criminal Code of the Republic of Korea and other laws including supplementary provisions and special laws are full of articles that define crimes and their contents.

It’s all a matter of detail.

Naturally most of them had long since drifted beyond the river of oblivion.

Since the same scene appeared in the original work I knew that this question would be asked and how someone would answer but wasn’t that knowledge as a law student?

This is my memory as a reader of the original.

In the end there was only one person who could answer the question Jang Yong-hwan posed right here and there.

    “What’s your name?”

    “This is Shin Seo-jun.”

“Shin Seo-jun… Group 6. “Yes answer me.”

Shin Seojun took a deep breath and continued answering without hesitation.

“Party A damaged B’s social reputation through the medium of the information and communication network called the campus community causing B to lose the election.”

    Understanding of the issue.

“Therefore we must first review whether the crime of defamation under the Information and Communications Network Act applies… but the crime is only valid if there is ‘the purpose of slandering others.’ Party A is excluded because it has a public purpose.”

Confirmation of the legal provisions to be applied.

“In that case we need to examine whether the crime of defamation under Article 307 Paragraph 1 can be applied based on the facts. At this time the question is whether the facts are ‘openly’ stated.”

    Presentation of the issue.

“According to the spreadability theory which is the position of the precedent the campus community satisfies the performance nature as it can be spread to an unspecified number of people. Therefore the structural requirements of Article 307 Paragraph 1 are established.”

    Subconclusion based on precedent.

“However there is a special provision Article 310 for defamation. Even if you defame another person you will not be punished if the content is truthful and solely for public purposes. Therefore in this case Party A will not be punished for any crime.”

Finally we conclude by pointing out another issue.

    The classroom became quiet.

The students looked at Shin Seo-jun with an expression of an infinitely distant being and Jang Yong-hwan also gave him an interested look.

“Have you ever studied criminal law?”

“I’m embarrassed to say with confidence that I learned it but I studied it to some extent.”

    To what extent?

If that’s ‘to some extent’ what does it mean for the rest of the students?

“That’s great. All the points you made are correct. “If I had received the midterm answer sheet I would have given it an A+.”

    “thank you.”

“But it won’t be ‘first place.’”

A whooshing sound erupted from the students.

“It was an excellent answer but there was one more issue that needed to be addressed in order for the best practitioners to become the best law students. “If you want to say that you studied at Hankuk University Law School you have to know how to do that.”

    Jang Yong-hwan asked again.

“Does anyone know what it is?”

    It can’t be there.

Shin Seo-jun was the only one who had reached the point where he could discuss each issue but there was no way the rest of the students could have picked up on the issues he had missed.

In fact I didn’t know what the ‘correct answer’ Jang Yong-hwan was thinking of in this scene was.

In the original no one answered correctly in the end and Jang Yong-hwan just passed on the question telling them to look for the answer during this semester.

A question whose answer sheet has not been made public.

    but….

    “oh. okay. “You sleep there.”

I suddenly raised my hand and stood up.

    “Hey are you crazy!?”

A shocked Hanseol tried to stop me but I easily ignored him.

In fact Shin Seo-jun has already explained all the really difficult parts.

What provisions should be applied? Also what is the basis of the precedent regarding that interpretation?

To answer this question one had to be familiar with the vast scope of criminal law.

As of now I cannot yet spit out an answer like that.

However it was quite possible to put a spoonful of alcohol on the table that Shin Seo-jun had prepared.

As it turns out it wasn’t such a difficult issue.

    “This is Park Yu-seung.”

“Park Yoo-seung… Group 10. So what do you think?”

    I opened my mouth confidently.
