I Became a Genius Law School Student Episode 37
“The data was stolen?”
Han Seol widened his eyes.
“okay. “To be exact I left it stolen.”
“…You let it get stolen?”
A puzzled answer came back.
Since the last meeting in the break room I have strongly advised people around me to always carry important books and materials with them or keep them at home.
Still since he had actually been robbed it was not unusual for him to react this way.
“There’s no real damage because we keep the original in its original form.”
“I’m glad if that’s the case.”
“Now all we have to do is wait.”
According to the original work there were about two days left before Shin Seo-jun started solving the problem.
Before then there will definitely be an opportunity to catch the culprit.
‘There’s probably a high probability that there will be a match today… there.’
Now the poor prey that had bitten the poisoned bait had no idea what was going on and just waited for it to finish digesting the food.
“What are you really thinking?”
When Hanseol saw me casually taking out the original notes and starting to study by comparing them with Minmae he let out a small sigh.
* * *
The incident occurred during Professor Park Soo-geun’s Civil Law I lecture.
“Then this concludes the lecture on unauthorized representation and expressive representation. “We’ve made all the progress until the midterm exam. Do any of you have any questions?”
“This is Yoo Taewoon professor.”
“is it so. “What were you curious about?”
Professor Park Soo-geun who progressed quickly as always was asked a question and Yoo Tae-woon raised his hand.
“There’s one more lecture left before the exam so what’s your progress that day…”
“Oh don’t worry. “I will attend class but I will not participate in the midterm exam.”
At those words the students’ faces also lit up.

In fact it was a story similar to that of Jo Sammosa.
This is because not being included in the scope of the midterm exam means that it will be included in the scope of the final exam.
Even if things are a little easier now the work that needs to be done doesn’t mean it’s gone somewhere.
However for law school students who were facing an unfamiliar enemy called law for the first time in their lives it was inevitable that they would be more pleased to hear that their immediate burden would be alleviated.
The first semester of freshman year where everything is new and confusing.
This is because just adapting is not easy.
“Does anyone have any more questions? great. then….”
Professor Park Soo-geun looked at his watch and started crying.
There were still 15 minutes left until the lecture officially ended.
The students had a hunch.
‘That time’ is back.
“I’ve received all of your questions so now it’s my turn to ask a question right?”
As Professor Park Soo-geun operated his laptop the lecture PPT on the screen skipped through.
Eventually a page labeled ‘Practice Problems’ appeared.
“Who wants to solve this problem?”
If Professor Jang Yong-hwan’s class had ‘assignment points’ Professor Park Soo-geun’s class had ‘attitude points’.
Total score is 10 points.
The evaluation method is simple. At the end of the lecture for each part practice problems are revealed and an opportunity to solve them is given.
Based on the end of the course the rank is determined based on the accumulated number of participations and solution results.
10 points from 1st to 5th place 9 points from 6th to 10th place…
Well it is a structure in which points are awarded differentially according to ranking.
Looking at it this way it seems better to just raise your hands and move forward. But that wasn’t always the case.
If a correct solution is given participation is acknowledged but if an incorrect solution is given the number of times recorded is deducted by one.
-If you misinterpret what was taught just before it means you didn’t focus on the lecture right?
Professor Park Soo-geun explained that it is natural to be disadvantaged in the ‘attitude’ score.
In the end you can’t just raise your hand without a certain amount of confidence.
In fact there were quite a few students who showed up from the beginning of the semester for no reason but their participation numbers went into a negative number reaching a point where recovery was impossible.
So at this point with the midterm exam approaching the number of students applying to solve the problems was almost fixed.
Shin Seo-jun Han Seol several other top students and me.
But today things were a little different.
“Professor I will try it.”
“I want to solve it too!”
“me too….”
There were quite a few applicants who normally would not raise their hands.
‘Oh my.’
Of course there may be many reasons.
Since half of the semester has already passed you may have calculated that you need to be busy participating in order to earn points.

Or with the midterm exam coming up everyone will have studied harder than usual so wouldn’t they be able to apply with a little more confidence?
‘But… there may be people with other reasons as well.’
I looked carefully at each person who raised their hand.
Most of them were unfamiliar faces but there were a few familiar faces that caught my eye.
Yoo Tae-woon and Kim Seung-pil also volunteered to solve the problem today and there were also several lower-middle class students who appeared in other episodes of the original work.
Seo Hee-jin the younger brother of the President of the Real Estate Law Society who had been crying in the break room the other day saying that a book had gone missing was also carefully raising his hand.
And one more person.
“Professor Kyo. “I also want to solve it.”
‘Oh. ‘You’re Bae Hyeon-joong right?’
Bae Hyeon-jung who had scolded me earlier hesitated and then belatedly raised his hand.
After that I became so depressed that I walked around quietly without any accidents so much so that I even forgot about its existence.
Anyway since he was a person of interest I decided to pay attention to him.
However Bae Hyeon-joong did not get the opportunity to present right away.
“great. “Let Younghoon Park solve this problem.”
“Yes Professor!”
Another student who jumped out with a cool attitude looked at the question on the PPT and explained it.
“It is an issue related to the scope of third parties protected from ratification of unauthorized representation under Article 133 of the Civil Act.”
Younghoon Park pointed out several basic issues and drew a neat conclusion.
“The soldier is a transferee of the claim but he does not meet the conditions for opposition so he is not a third party protected by Article 133. Therefore B acquires the bond according to the retroactive effect of ratification.”
I carefully reviewed in my mind the development and basis of Park Young-hoon’s logic. There was nothing particularly wrong. Although the content was a bit lacking it was unavoidable because it involved the concept of bond transfer which I had not learned yet.
‘Um okay. passing.’
“It was a good solution. “You can come in.”
“thank you!”
Professor Park Soo-geun sent Young-hoon Park away and moved on to the next page of the PPT. Then another problem appeared on the screen.
“Yes this time. Bae Hyun Middle School student let’s solve it.”
“yes. Ah I understand…”
Bae Hyun-joong must have lost a lot of confidence after that day and he stood on the podium with a timid attitude stuttering even his first words.
It was to the point where I couldn’t even find the image of him always acting arrogantly.
‘Was it that big of a shock? Then perhaps?’
I blinked and focused on his presentation.
“Uh so…”
Bae Hyun-joong kept looking around looking around and solved the problem in a trembling voice.
“The issue is whether the right of retaliatory representation can be the basic right of representation under Article 126….”
Although he seemed to be driven by some kind of anxiety he continued to solve the problem step by step anyway.
It points out the relationship between prerequisite concepts cites the position taken by precedents in factual situations similar to the problem and then draws a conclusion.
“Accordingly… Party A is responsible only for the 20 million won portion where the act of reappointment occurred.”
‘hmm. ‘Not bad?’
Although he lost confidence Bae Hyun-joong’s solution was actually a step forward compared to the last time I saw it.
In particular it was a pool that showed a lot of thought from a variety of perspectives to ensure that no issues were left out.
‘But that doesn’t mean you aren’t either.’
While I was pondering Professor Park Soo-geun nodded and tapped Bae Hyun-joong on the shoulder.
“I heard you well. “Please return to your seat.”
“Yes yes….”
Once again Professor Park Soo-geun handed over the PPT.
‘Oh it’s a bit complicated this time.’
At the same time that he was thinking that Professor Park Soo-geun also shook his head.
“This is the last question for today. It is also the most complex problem. “Is there anyone who can solve it?”
[Practice Problem 3.]
Person A is Eul’s younger cousin and is close to Eul. He often makes personal transactions on behalf of Eul such as receiving a loan from a bank in Eul’s name at the request of Eul.
Then one day A secretly took Eul’s personal seal and signed a sales contract with his close friend Byeong in Eul’s name to purchase apartment X owned by Byeong. Next A withdrew 100 million won from B’s bank account and paid it to B as a down payment.
A heard from Byeong that a redevelopment plan for the area near Apartment
However in a later court Eul and Byeong were unable to prove the existence of these facts.
However immediately after the sales contract was signed the area near Apartment X was designated as a development restriction zone.
As a result the market price of Apartment
Problem: Let’s ask Eul to pay the deposit and the balance.
(1) Person B protested saying ‘I am not aware of this and since Party A is the party who entered into the contract I am not responsible for performing the contract.’
(2) Then the patient claimed that the sales contract in this case constituted ‘express representation.’
(3) Next Byeong argues that if express representation is not established A should bear the ‘liability of an unauthorized agent’ based on Article 135 of the Civil Act.
Discuss the merits of each claim (40 points).
‘…That’s a lot to ask for.’
Since it’s not a real test that score of 40 doesn’t mean anything.
Nevertheless the reason it is indicated is to let you know that there are not just one or two issues that need to be addressed but a major issue.
Someone muttered as if they were appalled by this.
“Oh this is a bit much.”
Certainly the guys who had been raising their hands so brightly seemed to be hesitant this time.
This is because just because there are many questions like this does not mean that the number of participation is given more than other questions.
On the contrary as the number of mistakes increased the possibility of losing money also increased.
‘Hmm I don’t think this will work.’
Actually there was a reason why I was paying attention to the students’ presentations right now.
Materials that were stolen or allowed to be stolen yesterday.
There the practice problems and answers that Professor Park Soo-geun would reveal today were written in full.
Professor Park Soo-geun once said that he had his own rules when writing exam questions.
That was only in the mock exams for the last three years of the bar exam.
Likewise there were rules for the practice problems brought to class.
Before becoming a law school professor Professor Park Soo-geun made a name for himself as a bar exam instructor in private academies and at that time he had a book of creative workbooks for concept confirmation published under his name.
Unfortunately this creative workbook was ignored by the market.
The reason is that from the test taker’s perspective there is a lot to study just by looking at the previous exam questions but there is no time to buy and solve creative questions.
In the end this masterpiece of conversion soon went out of print and was forgotten by everyone.
All of Professor Park Soo-geun’s practice problems for his presentation were taken from that book.
He seems to have a certain attachment to this work because it is like a child to him.
I knew this so I selected the main issues from the book that covered the scope of this test and attached them to the materials the criminal brought along with an explanation.
They even kindly added a subheading called ‘Civil Law I Concept Confirmation Example’.
‘But… we planted traps one by one.’
Incorrect information was intentionally mixed in for each issue.
For example when citing a case law the case number and overall content are kept the same but only the conclusion is slightly changed to make it wrong.
I thought that the criminal who took my materials and studied them would not be able to sit still after seeing a lot of issues he knew come out during today’s presentation.
This is a person who is so desperate for grades that he touches other people’s things and is not confident in his own skills to the extent that he should.
Wouldn’t it be difficult to pass up such a golden opportunity?
Therefore there was a high possibility that among the people presenting today there would be an idiot who would spit out the same trap I had planted.
‘But it’s only a possibility.’
It seemed like the culprit had not yet been identified.
At least there was no one picking up the nonsense I mixed up.
Personally I was slightly hoping that Bae Hyeon-joong was the culprit but it seems that wasn’t the case.
Perhaps because they were overwhelmed by the force of Exercise 3 no one raised their hands anymore.
The students who usually gave presentations didn’t seem to bother participating because they had already earned a lot of points.
It’s okay.
Even if it wasn’t necessarily about Civil Code I there were a lot of other traps hidden in the material and there were still several more opportunities to use them.
Now was not the time to be impatient but a time to hold one’s breath and wait for the other person’s mistake.
With that in mind it was the moment I took my eyes off the podium.
“professor. “I’ll give it a try.”
“Oh good. “What is your name?”
Someone raised their hand and stood up.
“This is Seo Hee-jin professor.”
The reason I got into this case.
It was Seo Hee-jin the younger brother of the president of the Real Rights Law Society.
