I Became a Law School Genius – 31

I Became a Genius Law School Student Episode 31
For Han Il-gu law school was a system of love and hate.
When I was in law school everything was different than it is now.
It was a time when law like all other humanities and social sciences was treated as a proper academic discipline.
That is why he a scholar was appointed as a professor and he was able to freely lecture among the profound fundamental ideas of law.
Of course even back then there were people who thought of law school as a place to prepare for the bar exam.
There was an atmosphere in which the value of law school was judged based on the number of students who passed the bar exam rather than the quality of legal education and students often took leave of absence from school to prepare for the bar exam or openly solve exam papers during class.
However it is a completely different matter to say that it is simply the perspective of ‘some’ and that it becomes the ‘essence’ of the system.
Since the law school era began Han Il-gu has felt disapproving gazes pouring down on him at every moment.
The director secretly suggested that he teach a curriculum suitable for the bar exam and he stubbornly persisted but before he knew it his course was ranked last in the number of applications among constitutional law professors.
‘It is an insult to academic jurisprudence!’
Han Il-gu felt a great sense of humiliation.
Whether it was truly an insult to the law or an insult to himself as a young man who went abroad to study wiping away tears after failing to pass the bar exam was not a distinguishable issue in Han Il-gu’s mind.
Of course it wasn’t all bad.
Ironically the students listened to Han Il-gu’s class more attentively than ever before.
Law school credits are useless once you take the bar exam but law school credits have a decisive impact on your career path.
In fact it was as if my life depended on the professor’s hands.
It is already widely known that it is impossible to prepare for the exam he is taking.
The students listened intently to Han Il-gu’s voice wondering if there would be any hint.
Law school does not pay due attention to his academic achievements.
But at the same time it gave him transcendent authority as a professor.
In this contradictory situation Han Il-gu’s personality became increasingly distorted.
“Number 44 Park Han-yul. “What is sovereignty?”
“uh….”
“A person who studies the Constitution can’t even answer what sovereignty is?”
At Han Il-gu’s urging the student who was called looked over the lecture notes and gave a general definition.

“As the highest power that ultimately determines the nation’s decision in a modern democratic country it comes from the people….”
“Stop stop!”
Han Il-gu shook his head.
“That’s just a tautology. Let’s change the question. What does ‘sovereignty’ mean in Carl Schmitt’s constitutional political theory?”
The student became mute and kept his mouth shut. I try to look through the lecture notes but I can’t find it.
This is because Schmitt’s explanation is written in the principles section of the Constitution not sovereignty.
“Ha… next. Number 27!”
“Number 62!”
“Number 13!”
No matter how many times the name was called there was no surprising answer.
Han Il-gu knew very well that the reason was not because they were stupid.
His students were talented people who could come up with great answers as long as they put their mind to studying.
Because this is Korea University Law School.
So there is only one reason why they sit back and stare at Hanil-gu like a sack of barley.
I didn’t study.
why? Because there is no need.
Because you won’t appear on the bar exam.
Because you can’t invest that much time into your own subjects while studying civil law and criminal law.
It was only a superficial authority.
What is the use if students bow down to themselves bow their heads without saying anything and repeatedly apologize?
Deep down all of them are defining the tower of learning they have built throughout their lives as ‘useless.’
“At this place the best legal education institution in Korea! “Is there no one who can explain Schmitt’s theory of sovereign dictatorship!”
It was a moment when I screamed because I didn’t want to admit the futility.
“Uh oh….”
With a low groan the male student sitting halfway raised his head rubbing his eyes.
Did you sleep? How dare you? In my class? Han Il-gu’s mood which was already at its worst was completely shaken.
‘That guy… number 38. Park Yoo-seung.’
Han Il-gu’s extraordinary brain matched the face of a dozing student with the attendance sheet.
Recently he was a student whose name was popular among professors.
There were many rumors that he was a dark horse who had achieved remarkable growth even though he had received a miserable grade on his first test after entering the school or that the vice president had taken a beating from him.
When Han Il-gu heard that story he felt relieved.
As an elder other professors could not treat him carelessly but the vice president constantly harassed him by talking about his performance and passing rate.
But now it was just exasperation.
With such brilliant talent. He must have put in just as much effort since coming here.
‘Even for a guy like that my class isn’t worth studying…!’
“Number 38. “Park Yu-seung.”
So Han Il-gu called him by his name.

“yes?”
Park Yoo-seung answered with a puzzled expression.
“Students answer. “I’m sure I fell asleep during class because I was so confident that I had nothing more to listen to.”
Roaring laughter erupted here and there.
I don’t know but that guy named Park Yoo-seung didn’t seem to have much of a reputation.
Well the stone that originally sticks out is the correct one.
When someone unexpected achieved outstanding growth it was natural to start with jealousy.
‘…I’ve lost my mind so much.’
Only then did Han Il-gu realize that he was being excessively grumpy.
What crime can the students have?
The problem was the flawed system that forced students to master the law by taking the exam within a short period of three years.
An environment where you can’t study in depth even if you want to.
‘I won’t be able to answer anyway so I’ll just have to lighten the mood and move on.’
It was when Han Il-gu was thinking like that and clearing his throat.
“You mean the concept of sovereignty in Schmitt’s constitutional theory.”
Park Yoo-seung opened his mouth.
“It is a personal power that can carry out political decisions regarding a state of emergency and its basis lies in the constitutional power itself which cannot be excluded by any constitutional norm.”
“Okay okay. You might not know… What?”
The answer is exactly the same as the expression used by Han Il-gu in his paper published last year.
Han Il-gu’s dim eyes suddenly widened.
* * *
‘…Did I say that for no reason?’
After seeing the Constitutional Court’s dramatic reaction I felt a little regret.
Because I was caught dozing off and I didn’t want to get tired after being caught I chose an appropriate expression to answer.
Then the Constitutional Court began asking various questions with a shining face as if his dead son had come back to life.
Thanks to this I ended up having to answer the barrage of questions while sweating.
‘I’m not an expert like you!’
At best my understanding was limited to a few glances at the document summarized by ‘Nalmeok’.
It’s just enough to come up with test answers or something plausible but in fact I’ve never even opened anything like Schmidt’s books.
If even a slightly in-depth question was asked the underlying cause would soon be revealed.
Fortunately by the time I ran out of things to say the Constitutional Court nodded as if satisfied.
“Great!”
The Constitutional Court shouted with emotion.
“In an era when even the best educational institutions in this country have turned into wastelands of theoretical law I saw a ray of hope in this student.”
‘No it’s not that bad.’
“Please everyone applaud Park Yu-seung. “He is creating real learning even in this harsh environment…!”
‘Because it’s not…’
The Constitutional Court was not originally a person who gave praise to students.
It was fortunate that no one scoffed or criticized me for being substandard.
Everyone was left dumbfounded when such a person changed his attitude and painted his face with gold.
Especially since I was the one involved I couldn’t help my face getting hot.
What kind of real learning is real learning?
I had no idea that I would be praised so much for the knowledge I hastily gained to prepare for the exam.
Only the study members who knew the truth were secretly lowering their heads and laughing.
‘It would be better to be criticized….’
But that’s my situation.
It seemed to appear differently to those who saw it.
“What’s wrong with the decision?”
“How on earth did he study something like that…?”
“I am a graduate of the Department of Philosophy and I briefly covered Schmidt in my 4th year major class. “It was difficult so I couldn’t understand it and gave up.”
“But Park Yoo-seung is in management.”
“What is it really….”
Chatting words mixed with the sound of applause could be heard from all over.
This is truly overrated. I tried to extinguish the fire before it spread further.
“No Professor. I came across a few papers by chance so I just picked up the expressions that I remembered. To truly understand the meaning of a concept…”
“That humility is the ideal quality a researcher should have.”
‘I’m really going crazy.’
“Don’t be hasty in assuming that you understand. Constantly doubt your own knowledge and look beyond the text. “I can say this for sure.”
The Constitutional Court’s eyes lit up.
“Park Yoo-seung has talent as a legal scholar.”
The class went by like that.
Heonjae must have been in a better mood but for some reason he was no longer angry and lectured steadily and finished the class on time.
I quietly left the classroom among the other students.
No I tried to do that.
“Park Yoo-seung let me take a moment.”
Unfortunately the moment he placed his hand on the doorknob he was caught by the Constitutional Court.
‘this. ‘I have to go study for my exam.’
There was less than a week left until the midterm exam.
I didn’t want to waste my time on something like this.
Just today there was a mountain of things I had planned to study.
Therefore I turned my head with the intention of politely declining the Constitutional Court’s invitation.
but.
“It will only take a moment. “It’s because I have something I want to show to someone as qualified as Park Yoo-seung.”
As soon as I heard those words I was seized by a strange intuition.
‘There’s something about this.’
