I Became a Genius Law School Student Episode 29
“no. But accuracy can’t be guaranteed…”
Seungpil Kim made a fair tackle. It was time for me to step up.
“I can guarantee it. Accuracy.”
I took out a thick folder from my arms.
It was a printed copy of the very paper that was now summarized on the wall.
“Over the past few days I have been reading and analyzing this paper. And what you see here is a summary that I put together myself.”
He took out four or five thin sheets of paper from the top of the folder and waved them.
Seungpil Kim took it and read it. Soon his eyes widened in surprise.
“…I can’t believe it.”
Seungpil Kim was impressed.

Seungpil Kim is a reporter.

The remaining papers were selected one after another and one by one they were turned into shallow summaries.

Even if it is a summary it feels a bit overwhelming to read all 12 pages from the beginning.
However it is a different story if each person studies only two pages and then explains what they understand to each other.
Reading a text you understand is much faster than reading a text you have never seen before.
It becomes easier to read it two or three times.
In this way the effort required to draft the Constitution can be minimized and the number of readings can be increased to engrave it in memory.
“There is no need to read hundreds of pages of lecture notes or thick papers.”

I bowed lightly to Oh Ki-tae a client at the Legal Clinic.

Seungpil Kim checked the case summary I sent him on his smartphone.
It was the same incident in which Oh Ki-tae’s father suffered a fall accident at a nursing home.
Kim Seung-pil’s eyes narrowed as he scanned the screen.
“I know what you’re thinking.”
I nodded slightly.
“Mr. Oh Ki-tae. How are things going since then?”
“Oh don’t say anything. That dark-hearted director is the one!”
Oh Ki-tae seemed to think that this was the time and burst out in anger.
“Why are you telling me that if I have something to say I should do it in court?”
As previously confirmed the reason Oh Ki-tae’s father suffered a fall accident was because the caregiver had messed with the wheels of the walker.
Oh Ki-tae met the care worker separately and received a confessional statement.
The problem was that the nursing home refused to pay compensation based on user responsibility and maintained the attitude that if they really wanted to get something they would fight in court.
However Oh Ki-tae does not have the strength to fight a lengthy legal battle.
Even though I felt embarrassed I couldn’t help but stamp my feet.
“To be honest I just want to go to court and get hit. But since I have a living to make right now… it is not feasible to use a lawyer.”
“I understand.”
I comforted Oh Ki-tae.
“Actually I made an appointment today to talk with the director of the nursing home regarding Mr. Oh Ki-tae’s case. “That’s why I called Oh Ki-tae.”
“How? “When I call that guy he just snorts and hangs up…”
It’s not like I had any special talents.
– This is Korea University Law School Legal Clinic. I have something to tell you about an unfortunate accident that occurred at your nursing home.
Well when I brought up my affiliation they only agreed to an awkward meeting over there.
After all a person has a worthy title and must be looked at.
Hankuk University Law School? Legal Clinic? For some reason doesn’t it feel like something very annoying and headache will happen if you ignore it?

Even the precedent interprets this concept of ‘category of official conduct’ extremely broadly.
For example let’s say a superior assaults or sexually harasses a subordinate at a company.
It is clear just by looking at it that sexual harassment or assault is not an act included or related to ‘job’ in any sense.
However if user responsibility is denied for this reason it becomes virtually impossible for the victim to hold the company responsible instead of the perpetrator.
In the end the user responsibility regulations that were created for the purpose of protecting victims are becoming meaningless.
For this reason precedents have acknowledged the establishment of user liability even in cases such as those mentioned above by comprehensively considering the legislative intent and the circumstances surrounding the case.
“Moreover there is ample scope to consider managing walkers and maintaining them in a safe condition as part of the duties that nursing care workers normally perform. “As an employer the director is responsible for this incident.”
“…Ha this is true.”
The director sighed as if he was annoyed.
“If you like to follow the law so much why don’t you go to court and file a formal lawsuit? “Why do you keep coming and bothering me?”
“Going through court procedures takes time and money. It will be a cumbersome and wasteful process for both us and the director. Rather it is better to resolve matters through agreement….”

The director raised the corner of his mouth in a mean manner.
“I don’t care. What’s left anyway is time and money. If you want to sue do it. “Aren’t you the one over there who is having a hard time because the lawsuit is burdensome?”
“This bastard is so incompetent!”
Oh Ki-tae in tears stepped forward and Kim Seung-pil caught him and stopped him.
Certainly the director of the nursing home may have had a rotten conscience but he was not stupid.
He clearly saw that the reason we were trying to compromise was because of the client’s circumstances.
“You bastard!”

When Oh Ki-tae expressed his anger the director responded with ridicule.
I said quietly as I watched that happen.

“Nursing homes must give trust to residents’ families. “No one would be crazy enough to entrust their precious family to an organization that is unable to prevent or take responsibility for the deviation of its guardian.”
“Are you threatening me now? “Don’t you know this is defamation?”
“Article 310 of the Criminal Code. “If the act is a true fact and is solely for the public interest no punishment shall be imposed.”
This is something that was covered earlier in Professor Yong-Hwan Jang’s class.
“Spreading the truth about poorly managed nursing facilities is a beneficial act that promotes the public welfare of countless elderly people and their families.”
“profit…!”
“But if the director is willing to do his duty then such ‘sloppyness’ will never have existed in the first place and I will have no reason to expose it.”
Saying that you will expose the truth if you do not agree to an agreement can be a threat.
However if you want to make your mistakes known for the public good it is another story to give you one last chance to correct them before doing so.
It may sound like a play on words but isn’t it really different?

The director of the nursing home whose face was bright red eventually burst out laughing.

He spoke in a teaching tone.
“It’s not as easy as saying something to the media. “It’s not like a student just goes to a school with materials and asks them to write an article and then they write it.”

The nursing home director wiggled his fingers.
“Or something. “Do you have any influential acquaintances who can control the media at will?”
The nursing home director’s thoughts were not without basis.
A nursing care worker injures an elderly resident and the nursing home tries to cover it up.
Although it was a topic that could cause public outrage it was not very provocative.
Accidents like this happen dozens of times a day.
Not all of them could receive public attention.
Of course there was no reason for the media to cover it as news.
Even if the reporters actually come out to cover the story you may be able to cover it up by ‘treating’ them well and sending them away.

“Seungpil Kim. “Please introduce yourself.”
Kim Seung-pil who suddenly took over the baton opened his eyes round but quickly realized my intention and nodded.
