I Became a Law School Genius – 18

I Became a Genius Law School Student Episode 18
The first week of semester went by hecticly.
First of all the number of classes has increased significantly.
During the free program there was only one civil law lecture but in the regular semester there were two lectures with ‘General Rules of Civil Law’ in the first part and ‘Real Rights Act’ in the latter part.
Is that it? The Constitution which had been neglected so far had to be properly taken care of as regular lectures were held.
There were even elective courses that I had to take to get my grades so my schedule was bound to become tight right away.
“Park Yu-seung. “What do you think about selection?”
“International Trade Law.”
International trade law was the most frequently chosen subject on the bar exam.
If I had to take an elective course I wanted to do it in a way that would help me on the exam.
The theory was international law. It was also a subject with a very high test take rate.
“What about one day?”
“Internet and Law.”
“…What is that?”
“I don’t know. Was it on the course registration list? “I heard they weren’t going to take the midterms so I quickly picked it up.”
Like Lee Ha-ru the only choice I had was to be comfortable.
Even though I finished free I might have to be thankful that he showed up for class regularly.
‘what. ‘It doesn’t matter to me since it’s not a group evaluation anymore.’
Still I’ve invested a lot of time into this guy so far so I want to pull out whatever I can.
To do so the basics had to be laid to some extent before the time came.
‘Maybe by the end of this month at the earliest.’
This was the reason why I dragged him around and made him study at least as little as possible.
Either way it was a busy and fulfilling day.
Every day from morning to 3pm I listen to lectures and then go straight to the library to preview and review.
My only leisure time was to visit the arcade once in a while to keep Lee Haru motivated.
“Isn’t that today?”

“Uh huh. “First of all I need to study enough for today.”
“shit….”
I grabbed Lee Ha-ru who was drooping helplessly and dragged her to the study room.
Hanseol must have mastered the reservation competition by now and has never once failed to reserve a study room.
“This is a body that has been trained through four years of hellish course registration.”
Hanseol smiled proudly and set down his luggage across from me.
After all if you become friends with excellent people you will fall in love with them.
With my back buried in a soft chair I lined up the books to study on the desk.
“Then do as you always do. “Let’s do our own thing until 8 o’clock.”
The time is now 3:30 PM. It was an environment where I could concentrate and study for 4 and a half hours even if I couldn’t do it.
First I glared at the two books I took out on the desk.
One volume is [Civil Law Knots].
The other volume is [Summary of Criminal Law].
It was a steady-selling basic book for each subject of civil law and criminal law that I have used so far.
“…Do you only see that?”
“That’s all. “These guys alone are worth a few thousand pages already.”
“But there are a lot of precedents that aren’t there.”
In the place where Hanseol said that several volumes of case law books were piled up.
It was a mountain of books that made your mouth drop just by looking at it.
Oh my gosh after studying that much no matter what problem I look at I immediately come to a conclusion and say ‘Oh this is the precedent.’
But I had no intention of going that far.
My theory was that there was no need to do that in the first place.
“You don’t have to have it.”
“?”
“If you have a solid foundation you will be able to solve questions even if you have never seen them before.”
With those words I unfolded the [Civil Law Knot].
The corners of the book were so worn and tattered that it was hard to believe that it had been bought only recently.
“A lot of people make mistakes when studying law for exams.”
I turned the bookshelf page by page.
“It means studying by increasing the amount.”
It was the same during the bar exam and it is the same for law school students today.
In the past and present those who studied to become lawyers were generally the highest-ranking elite.
These monsters easily chew up and swallow high school grades evaluation board mock exams or the level of study taught in undergraduate schools.
Therefore they often suffer from the compulsion to study ‘until there is nothing they don’t know.’
You must have all the letters included in the test range in your mind and there should never be anything you see for the first time among the questions you face in the exam room.
but.
“That doesn’t work in law.”

This is because the volume is ridiculously large.
Even if you add up the amount of study you completed over 3 years of high school and 4 years of college it is barely enough to cover the amount of study required to ‘perfectly’ master one civil law subject.
There are over 1000 articles in the Civil Code alone.
How many theories and precedents have been accumulated over decades for each article and concept?
It makes no sense to go into it all.
Moreover the bar exam is not limited to civil law.
You have to study the criminal law constitution civil procedure law criminal procedure law administrative law commercial law and even the elective law before going to the exam center.
How soon?
In just three years.
It was an incredibly tight schedule.
This means that if you approach it with the mindset of becoming a master of law and a conqueror who knows everything you are bound to fail.
So how did I pass the second round of the bar exam which was much more competitive than the current bar exam in a shorter period of two years?
“You have to go backwards. “Reduce the amount.”
I withdrew my fingers from turning the pages fluidly.
On the unfolded page some paragraphs were heavily underlined while others were completely crossed out.
“…what’s this?”
“The underlined text is from the past. “The one with the scissors doesn’t come out.”
Law is a terribly bulky discipline.
However not all of that content can be included on the exam.
Even the enormous civil law exam contains only three questions.
Let’s put ourselves in the position of the test taker.
If you can only ask three questions out of so much content on the exam what should you do? What do you want to put out?
Of course we have no choice but to select only the ‘important things’ and publish them.
If so the law governing this thick civil law book must also change completely.
First we start by establishing a system.
Starting from the court at the beginning of the General Civil Law Provisions to the non-traditional security real rights at the end of the Real Rights Act.
You must have a table of contents of all concepts in your head.
“Significance. Requirements. effect. Major Leading Cases.”
However there is no need to try to fill the entire table of contents with detailed information.
It is right to keep track of the major legal principles that are always presented including the latest and most minor precedents.
Since other people know it well anyway you have to know it to that extent to be able to differentiate yourself.
However for things that are less important it is enough to be able to explain them one line at a time in each table of contents.
Even if you show up for the exam anyway no one will know.
If you faithfully understand the basic legal principles and can solve them by applying them with a legal mind no further memorization is necessary.
“You have to look at it like this. “If you separate out what you don’t need to read the amount of reading you have to do when you read it again is drastically reduced.”
Mark the parts that have been passed and add additional precedents. The parts that need to be removed are erased mercilessly.
At first it took me several weeks to finish reading one volume because I was doing this work.
Next is a week.
Then three days.
And then two days.
As of now the first week of semester after free-ro is over…
“day.”
I picked up the 1300-page book and waved it in front of Hanseol.
“You can read this book from cover to cover in one day.”
This is called a single-volume learning method.
In particular the process of reducing the repetition time was quick for me perhaps because I had already taken the exam.
The same work had been completed not only on Minmae but also on [Summary Theory of Criminal Law].
What can you do if legal knowledge is highly volatile?
It is enough as long as the speed of pushing in is faster than the speed of pulling out.
Once I established the foundation each time I repeated it the legal system within me became stronger and stronger.
Originally I didn’t reach this point until my third year of law school right before I took the bar exam.
However there was no way I could lose face by taking the bar exam until the second round and running at the same speed as others.
‘Although the results are limited to civil law and criminal law…’
The person I am now is a completely different person from the person I was a month ago.
The culmination of all my test-taking know-how.
It was thanks to these two treasures that I would take with me until I graduated.
“That doesn’t make sense.”
“It’s true. “Just as a test ask me anything.”
Hanseol took my sleeve and opened it to any page and read.
“Can the tenant’s debt incurred after notice of transfer of rental deposit return claim be deducted from the return claim?”
“You can do it.”
I answered immediately.
“This is an issue that arises because Article 451 Paragraph 2 stipulates that opposition can be made for reasons that arose ‘before the notice of transfer’ but based on the contrary interpretation opposition cannot be fought for reasons that occurred after the notice right?”
In my head I find a table of contents to include the questions and answers.
It wasn’t difficult. Because it was a problem that I had already read several times and finished setting the address.
“It’s still possible. “Originally the lease deposit return claim arises after deducting all liabilities of the lessee incurred up to the return of the subject matter.”
“…It’s absolutely ridiculous.”
Hanseol pulled out his hair.
“Are you the guy who stayed up all night memorizing the effects of the statute of limitations a month ago?”
“The power of single volume and repeated reading.”
“I feel like a fool….”
Hanseol looked at the pile of case law piled up in front of him and complained but that was an absurd lie.
In the first place if you had the memorization power like her to cram an entire book of precedents into your head you wouldn’t have done something like this.
‘Hanseol’s method is inefficient but if possible it is possible to prepare everything perfectly without any accidental damage.’
However if the bird had to follow the stork its crotch would be torn.
Since he is just an ordinary person and not a trained memorization genius he competes based on know-how.
If you feel wronged over this sad struggle then you are bitter.
I turned my gaze away from Hanseol and buried my head in my book again. Today’s quota had to be met.
After being immersed in studying for a while Lee Haru clapped his hands.
“Eight o’clock. Eight o’clock. Time to play game.”
He said he was just waiting for this moment.
“Has it happened already? Okay let’s go.”
“I’m definitely going to win at least one game today.”
“You’ve gone a long way you guy.”
Han Seol also stood up.
“I’ll go first.”
“I’ll see you tomorrow.”
Lee Ha-ru muttered softly as she watched Han Seol’s back moving away.
“It would be nice if Hanseol could play with us too.”
“That friend can’t do it because of the curfew. “If you’re late next time you’ll be taken home as soon as class ends.”
“Still.”
It was a pity but it was impossible to interfere in other people’s family circumstances. Hanseol himself is also following it.
“Oh I can’t play next week either.”
“omg. why.”
“I have one more thing to do.”
“…?”
* * *
“I want you to gain a variety of experiences.”
These were the words Jang Yong-hwan uttered at the first advisor meeting at the beginning of the semester.
“The fact that you chose to be guided by me probably means that you are interested in the prosecution. However I have no intention of training people who are good at studying to become prosecutors. Participate in various activities inside and outside of school and submit performance records.”
Meanwhile Yong-Hwan Jang gave his students a list of all the programs and competitions they could participate in at Hankuk University Law School.
Volunteer work in a remote village.
Jain Court Argument Contest.
Legal Clinic.
Intellectual Property Law Contest.
And so on.
It was said that those with insufficient performance would be expelled from the guidance meeting and assigned another guidance professor. Of course it wasn’t just a penalty.
“For those who excel I will write a letter of recommendation during the prosecutor’s practical training in the summer of their second year.”
Sweet fruits were also promised.
Although the prosecution practical training itself is not reflected in the prosecutor selection process it was a golden opportunity to expand my horizons and make an impression on current prosecutors while experiencing prosecutorial work.
As an aspiring prosecutor this is a story I can never ignore.
Therefore I had to participate in as many activities as possible.
‘Among these… Is this a legal clinic?’
Legal Clinic (Legal Clinical Class) is a program conducted at a law school under the guidance of a law professor or practitioner.
It was quite popular among top students as it allowed students to gain practical experience by providing counseling and legal advice to clients.
Requests are made through the Legal Clinic window established on the law school website.
It is a win-win structure in which students gain experience and clients receive free legal help.
Even though students are the subjects there is no need to worry about incomplete services because the written opinion is ultimately written through inspection by the professor in charge.
In the first place it was free and was sufficient as reference material before taking legal action seriously.
It was a course that allowed for continuous profits with each number of consultations.
Since it was an activity that took place on campus once or twice a week at most the burden was not too great.
‘The only problem is… the professor in charge of Legal Clinic is Vice Director Choi Seong-cheol.’
I closed my eyes for a moment and thought of Vice Director Choi Seong-cheol as depicted in the original work.
To put it in one word he was a ‘competent opportunist’.
I guess they say that a craftsman resembles the tools he uses.
Choi Seong-cheol who has been active on the stage of international financial disputes was a very calculating type and evaluated people only based on the profit or loss they would bring to him.
Even after pursuing fame and becoming a professor at Hankuk University Law School that temperament did not change at all.
To him students were divided into two categories.
Those that contribute to performance and those that do not.
The latter was not given this much attention.
‘That’s why I’m in conflict with Director Kang Chang-soo.’
Because of his ability he rose to the position of vice president but Choi Seong-cheol and Beopjeon Director Kang Chang-su had a close relationship with each other.
There were clashes and confrontations from all aspects from educational institutions to factional fights within the school.
Even now Choi Seong-cheol would be waiting for an opportunity to oust Kang Chang-soo and take over the position of director.
In the original work he was the person who most actively pushed for disciplinary action when Park Yoo-seung was expelled.
He’s not a person I really want to get involved with.
But I can’t make soybean paste because I’m afraid of maggots.
As of now I don’t have any advantage so I couldn’t miss out on the opportunity to build performance just by avoiding Seongcheol Choi.
So on the first day of activity I visited the classroom allocated for the legal clinic.
