I Became a Genius Law School Student Episode 121

    “I will judge.”

    The judge’s sentence continued.

“Defendant Kim Gap-dong is guilty of arson of a building in Hyeonju causing death and trespassing into a shared residence.”

Normally orders in criminal trials do not come out this way.

In the case of a verdict of not guilty or dismissal and if the defendant is found guilty only the type and degree of punishment to be received by the defendant is sentenced.

The specific details of each crime are written in the ‘Reasons for Judgment’ section of the judgment.

However this legal argument competition is only a mock trial and it is important to know what conclusion is reached for each crime.

“Lee Eul-nam is guilty of breaking into a common residence arson of a building in Hyeonju causing death and special theft by illegal use of a car light.”

This was the final conclusion the judge accepted after hearing each claim.

‘As expected the part about Lee Eul-nam driving without a license was left out.’

Not mentioning it means that they judged him not guilty. Kim Gap-dong’s guilt went as our team claimed but Hwang Seung-soo’s claim regarding Lee Eul-nam’s driving without a license was approved.

‘If this is the case… the problem is how to determine victory or defeat.’

This case was extremely complex even befitting its heavy name. How many crimes were at issue?

In this case victory or defeat could not be simply divided based on the guilt or innocence of the defendant.

It was the same situation as the final of the preliminary round held at Korea University. In this case a process of judging which side developed the better logic was necessary.

The other judges who were watching began to have random conversations with the judge.

What each of us holds in our hands is an evaluation sheet that scores our arguments. Those who seemed to have been thinking for a while nodded in unison as if they had come to a conclusion.

“First of all I would like to say well done to both teams. “They were both so great.”

The judge’s first comment was condescending.

“First of all it was good to clearly distinguish between parts that would be an issue and parts that would not. “We didn’t waste time arguing about unnecessary things but we did pick up all the key issues.”

Up to this point it can be said that the understanding of legal principles is sufficient. A smile bloomed on the judge’s face as he said that.

“As such… it wasn’t easy to decide whether to win or lose. “The defense?”

    “yes!”

Hwang Seung-soo responded vigorously to the judge’s name.

“What I wanted to give particularly high marks to the defense attorney’s argument was the unlicensed driving section. “It was good to understand that ‘road quality’ was an issue but it was especially great to carefully check the condition of the site before the incident.”

    “thank you!”

    ‘It’s a sore spot.’

What Seungsu Hwang did well was also my mistake. It was good to know that the road quality was a problem but after only briefly inspecting the site the existence of the manager was not discovered.

    “but.”

I listened to the judge nervously.

“There was a separate crime that received the highest points.”

    ‘This too.’

“It was the arson of the Hyeonju building.”

    ‘yes!’

“It was a very tricky problem. “There were double and triple traps set up.”

The existence of the first piece of wood was concealed from the evidence list.

By doing so it made it appear that the defendant had left before the start of execution and led people to believe that the issue was whether or not he took the lead in leaving the collusion relationship.

“To reach the truth you must first have an accurate understanding of the legal principles of both deviation and attempted suspension. Furthermore evidence of special theft that seemed completely unrelated. So… we had to reveal the existence of the ‘first piece of wood’ in the CCTV footage.”

The judge acknowledged that it was a very vicious structure.

“To be honest we were assuming that both teams would not be able to uncover the truth.

If the truth cannot be revealed. In other words both teams believe that this issue is not an attempted suspension but a departure from the collusion relationship.

The basis of trial is partyism. Judgment cannot be made on matters not claimed by either party.

If this situation had occurred the judge would have had to examine which side’s argument was more persuasive under the premise that the issue was departure from the collusion relationship.

“But the prosecutors got to the truth.”

Although it didn’t happen that way thanks to me.

“Understanding of legal principles. Excellent observation and concentration. Flexible ideas. It’s difficult if you don’t have everything. “It was so great.”

    “…thank you.”

“Did you say he was Park Yoo-seung a student on the Korea University team?”

    “Yes that’s right.”

“What career path do you hope to pursue?”

Suddenly what kind of question is this? I looked at the judge in confusion. Since I asked a question I thought I should give an answer so I hesitated and opened my mouth.

    “This is the prosecution.”

“this. “Are you planning on coming to court?”

    “…yes?”

“I’m asking this seriously. Even the trial researchers currently under me did not have such sharp senses. “The court needs talented people like Park Yoo-seung.”

    ‘oh my god.’

A love call to the court from a sitting judge. I think I quite liked it.

‘If I say I don’t think about this won’t they let me win?’

Of course that couldn’t have been the case. The Jain Legal Argument Contest is such a prestigious contest that it is impossible for the evaluator’s opinion based on a single word to change the results.

“It’s been a dream for a long time.”

“…It’s a shame. “After all those who once had the prosecution in mind rarely change their minds.”

Therefore I expressed my meaning in a euphemistic way and the judge just swallowed his mouth as if it was a waste.

“I will announce the winning team.”

    Announcement of final results follows.

“The winner is… the Hankook University Law School team. The runner-up is the Yonhee University Law School team. Thank you all for your hard work.”

    * * *

“There will be an awards ceremony! “Please gather all the winning and runner-up teams in the Civil Division in the conference room on the first floor!”

    Next was the awards ceremony.

I went to the awards ceremony location with my team members. When I arrived Shin Seojun was standing there smiling as if it was obvious. On either side of me are two Korean classmates I don’t know well.

‘I guess this guy won the civil affairs competition as in the original.’

If it was natural it was natural. Who could defeat this monster?

    “I’m not in civil affairs.”

    “Wow you dog is unlucky.”

Lee Haru scolded him but he couldn’t seem to deny it.

    “It was really fun!”

The Yonhee University Law School team came down behind them. Of course the one who ran at the forefront was Hwang Seung-su.

He offered to shake my hand with a very bright expression. It seemed like there wasn’t even a trace of bitterness left over the defeat.

“I learned a lot! As expected the world is wide and there are many masters!”

“That’s what I’m going to say. “I was dripping with cold sweat when I was accused of driving without a license.”

“Hahaha I feel rewarded when you say that!”

It was sincere without any exaggeration. In the end we won but it was a very close race. Thanks to this this final was a great stimulus to me.

    ‘Yeah you can’t be complacent.’

The road to law is an endless race. If you let your mind go just because you are ahead you will be overtaken in an instant.

It was a worldview filled with talented people full of talent and passion.

When I return I will have to study even more intensely. It was a time when I was swallowing that promise.

“This year’s award ceremony will be presented in person by Lee Hwan Director of the Court Administration. “All winners please wait.”

A murmur spread as the staff guided the staff.

“Wow the day is coming when I see the Director of the Court Administration in person.”

“I know. “It was announced in advance but I still can’t believe it.”

Two team members from Yonhee University Law School exchanged words with puzzled expressions.

“What is the Director of Court Administration? “Is it such a high position?”

Lee Haru saw that and lowered his voice and asked me.

“okay. “If you just look at the rank he’s at the ministerial level.”

    “Eck.”

“That’s it? The head of the National Court Administration is a position held only among current Supreme Court Justices. “Not only is he the head of an administrative organization but he is also a Supreme Court Justice.”

Naturally the ranking within the court was also top-notch. The position of Director of the National Court Administration is sometimes intuitively referred to as ‘Deputy Chief Justice’.

He was truly a being who was above all people below the Chief Justice of the Supreme Court.

‘That kind of person is coming….’

The hosting organization of the Jain Legal Argument Competition is the National Court Administration. Of course the award goes out in the name of the Director of the Court Administration.

That’s why I was given the opportunity to see and talk to him in person at the awards ceremony but he was so high-ranking that I would never have to meet him in my life.

    “Let the awards ceremony begin!”

After waiting for a while Lee Hwan the current head of the National Court Administration finally appeared.

An elderly lawyer with a thin build and gray hair walked into the conference room guided by the staff.

    ‘I don’t have a strong impression.’

On the contrary if you take away his neat suit and polite gait he has an impressive appearance that makes you believe he is a local elder. He was a different type from Kang Chang-soo.

Of course this is only appearance and beyond that there is bound to be immeasurable wisdom and experience.

As I watched without letting go of tension Lee Hwan soon cleared his throat and cleared his throat.

    “iced coffee.”

    A thin but dignified voice.

    “I’m here again this year.”

    You automatically become focused.

“Originally the purpose and history of the competition should be explained before awarding so it would be proper procedure… I guess you don’t want the story to be long right?”

Lee Hwan smiled as if he knew everything.

It wasn’t that it wasn’t it was a very welcome sound.

Everyone here has exhausted all their concentration. They all looked tattered like the skin shed by an insect that had shed its skin.

‘That Hwang Seung-su guy still seems to have a lot of energy but…’

Not everyone can be as cool as that crazy guy. Fortunately Lee Hwan seemed to have seen through this and got straight to the point without making any inconvenient comments.

“We will proceed with awards in the civil sector. To the runner-up Gangseo University Law School team.”

Following Lee Hwan’s name the Kangseo University Law School team came to the podium. Familiar faces were seen in the preliminaries video.

‘Did you say that person used to be an office worker? ‘That’s amazing.’

The man who appeared to be the oldest in the team stood at the front as the representative.

“crape. Runner-up. “You participated in the Jain Legal Argument Competition…”

He recites a stereotypical phrase personally hands the certificate and pats the man on the shoulder.

“next. To the winning Hankook University Law School team.”

Shin Seo-jun stepped forward as if he had been waiting.

    ‘The picture is amazing.’

With neat features and a straight look like a model student. The confident smile on his face makes him shine even more when he receives the award.

Since it was right after the finals even the slightly tired eyes were noticeable.

    “crape. win. “You…”

A flash exploded from behind with a clicking sound. I was curious and turned around to see reporters taking pictures.

It probably belongs to a newspaper that specializes in legal issues.

‘They say it’s a custom every year to publish an article covering the finals.’

Next it was the criminal department’s turn. When the Yonhee University Law School team was called Hwang Seung-su ran out with joy and the other two team members followed behind as if being dragged by the momentum.

    “You…”

    “Hahaha thank you!”

Hwang Seung-su shouts his thanks at the top of his voice right in front of Lee Hwan and suddenly lowers his head. He accepts the certificate and raises it to the sky as if he is bragging.

“You crazy guy what are you doing!”

Even the head of the Court Administration of the World looked dumbfounded by the antics and the team members were so appalled that they pinched Hwang Seung-su’s side.

“I guess I was very happy. Heh heh. “It’s something to be proud of because we’ve achieved such an incredible accomplishment.”

Surprisingly Lee Hwan generously laughed it off as if he thought it was cute. Of course that didn’t stop Hwang Seung-soo from being scolded by his teammates on the way back.

‘He’s like that guy until the end.’

Next the final turn of this awards ceremony.

“To the winning Hankook University Law School team.”

    It’s our turn.
